Default YES YOU'RE SAFE!!!

Purchases made from the time of the ruling on 3/29 until tomorrow, 4/5 @ 5pm are protected! Even if they haven't shipped yet, they were purchased in the window of okayness! Do not fret. Judge Benitez has protected you.

Right there with you. Still waiting on some myself. The ruling protects us at least. If certain vendors get cold feet, at least we'll get our money back.

I'd say they'll fulfill all orders placed by 5 PM tomorrow. Top Gun Supply has already confirmed they will; I suspect others will as well. Just my opinion. IANAL

You will be able to use those legally acquired items. As far as potential confiscation due to being "nuisance items" in the eyes of the state, I'm not sure.

Much of this depends I think on what constitutes a purchase by the deadline.

1) An order where your credit card is not yet charged and goods not yet shipped.

2) An order where your credit card is charged and goods are not yet shipped.

3) An order where your credit card is charged and goods are in transit.

4) An order where your credit card is charged, goods are shipped and received.

Note, some vendors do not charge your card (take your money in a transaction), until the product is ready to ship. Typical for backorders.

I called one vendor about this and they said to call back tomorrow and ask to speak with someone there who is knowledgeable on the matter. They were gone when I called. Bottom line, what IS a purchase? And what do vendors think that is?

If you click the "place order" or "submit order" button by 5PM, you should be fine.

I contacted Brownells because they do not charge your card until the product is ready to ship. NOT when you place the order. Palmetto State Armory charges at time of order. With Brownells, if an order placed on 4/4 is filled on 4/6, the monetary transaction did not occur until 4/6. Will Brownells still fulfill the order or consider the 4/6 as the date of the transaction and after the 4/5 deadline and as such, not ship high cap mags to CA? A Brownells person told me that it is possible they might cancel such orders and not ship. I told them they need to clear this up NOW! I am calling people at Brownells tomorrow when they open to get clarity. I will report back.

I made multiple orders Mon and Tues, bit the bullet for 2nd day and next day shipping on one order, as I did not want to worry about status of stuff shipped or received (or not) after inevitable cut off.

Received all today, big investment but was worth it. Still having trouble believing that this actually happened. Thank you God...and Judge Benitez!

Midway doesn't charge until they get it back in stock. I'm going to call them tomorrow to see what their policy is going to be and see if they can charge me early.

Just chatted with a employee at GrabaGun. As long as it remains legal, they will continue to fulfill/ship orders placed with them before their cutoff time of 5PM Central Time Friday 4/5.

^^^

The Judge opened the magazine flood gates knowing his decision would not stand. Then he was given the chance (threatened) to reverse his decision and he did, kind of, protecting those that took advantage of the flood gates being open.

At the same time poking the eye of the California Attorney General.

EDIT: he wasn’t asked to change his decision but threatened...

Judge Benitez knew AG Beccera would appeal to the 9th circuit so he granted a stay with carefully worded protections for all of us mag purchasers this week to prevent it from being unlawful.

The California Attorney General would have taken it to the 9th District Court of Appeals and they would have reversed it on their terms. He just bought us a little more time and beat them to the punch, setting his terms.

It wasnít reversed, the judgement was stayed. Itís not uncommon for a judge to stay their own judgement pending appeal. They do it out of specific kinds of concern or outcome.

I suggest reading the stay order as it breaks it down.

And yes, he still did us a great favor as well as a shot across the bow of the politicians who keep messing with 2A rights. And if you factor in Trump and the slow change of federal courts, as well as SCOTUS that gives the anti2A crowns a further pause. They have to thread lightly.

If we win en banc eventually then I suspect the state wonít push to SCOTUS. this scenario happened recently with a court case.

Below is the link to the case where DC did not appeal to the Supreme Court when it lost a CCW case:

My Brownell's order dated 4/2 changed it's status from "Order in Process" to "Order Shipped". My bank account was also charged. So, if your product is in stock, you should hopefully see it shown as being shipped at any time.

I am most nervous about my 4/3 order, which still shows as "Order in Process", but will report back more tomorrow after talking with Brownell's. Both of my orders shows as in stock.

When I talked with Brownells today, they said they typically ship out orders in 24 - 48 hours. With the crush of orders, I was told they are about 24 hours behind that. I was also told the warehouse people are working extra hours.

Our worry over the timing may be valid, or a real concern, depending on how Brownell's treats orders they cannot charge and fulfill by April 5. While it is late in Iowa where they are. it is interesting to see that their website, still advertises purchase of any mag in stock for California. Maybe they are just late taking that down, or really will take orders up to 5:00 pm Friday, and then charge/fulfill them later, taking the position that order received by them before 5:00 is acceptable. I told Brownell's if they will not charge/ship after 5:00 tomorrow, for orders placed by 4/5, 5:00 pm, they are going to have a ton of angry customers.

Do not rely on Brownells e-mail notification. Those It has been several hours since my order showed shipped and still no e-mail notice. Check your bank account and Brownell's site to see what is happening.

Phil

Is there any legal or 'official-ish' word on this? I'm seeing stuff like this all over social media:

Maybe. I really wish I knew, but will try to find out tomorrow when I can talk to them. I will post the results of that call tomorrow. I have some concerns for my one remaining order with then that is still in a state of "Order in Process". The goods were in stock at the time, and printing the invoice does show that. However, I see now, the item is out of stock and there is no backorder provision.

All uncertain ground we are on, but will try to clear up some of this with Brownells at least.

Look at it this way.

Mag ban, nobody except a few special people can buy LCM's

Judge ruled and ordered PC 32310 eliminated, everyone can buy mags.

AG threw a fit and demanded a stay, Judge ignored him.

AG stated he would appeal, Judge issued a stay.

The stay, in order to protect the people who rightly exercised their new found freedom, and the companies that helped, expanded the group of special people to include those that bought, sold, manufactured, or imported LCM's in the week before the stay.

Everyone else will have to wait until the appeals process is complete.

Doesn't sound right, make sure you have the right perspective.
