Default Triple B's status September 27th

I received an email from Triple B's and this is what they have to say about their lease:

We will be trading your target key for rounds effective October 1, 2019. No Refunds will be given.
Members & Non-Members will receive
Trap/Skeet Key - 3 rounds of trap/skeet
5-Stand Key – 2 rounds of 5-stand
Sporting Clays Key – 50 targets of Sporting
Bunker – 2 rounds of Bunker
We will be documenting this on your account information page with the key number and marking the key indicating the rounds were given.

Memberships –
We will not be selling memberships in the future.
Memberships expiring after 12/31/2019 will be prorated and targets will be added on your target keys.
Any membership expiring in the month of December 2019 or after will be honorary members until the county has made their decision with Oak Tree. You will be members until when and if we close.
Thanks for your patience and understanding. If there is a transition, we will try to make it as smooth as possible.


Meeting information
Lease Update (Trying to stomp out the false rumors). I apologize for the length of this e-mail, just trying to keep you as up to date as possible.

I took some time getting this out to you for a couple of reasons. We met with the County on September 19th and again on September 24th. There was a lot of information back and forth. Oak Tree Gun Club is who they are negotiating with now-- they submitted prevailing bid.

There are a couple of positive comments that came out of the meetings. First, they will be giving us a sixty day notice once (and if) the contract is signed. Second, they informed us we are next in line in the event they cannot negotiate a contract with Oak Tree.

A lot of you asked who you could call or write. The county said to contact Aram Pirjanian 626.588.5298, or e-mail APirjanian@parks.lacounty.gov. If you would like a response from the county you need to indicate it on your e-mail. I was informed that they are required to log in all e-mails. You can also request that your e-mail be forwarded to the Director of Parks and Recreation and to the County Board of Supervisors prior to signing the contract.

Why the County did not choose Triple B:
Each bid was evaluated and scored numerically, that is, each section of the bid was given a point score based on supposedly objective criteria. Highest point total won the bid for the contract [sort of]. Our bid scored pretty high in all categories except one-- the proposed concession contract for the next 15 year lease.

The County attached a proposed concession contract to the request for bid. It stated that we could submit proposed changes and language to terms that we did not agree with. We were further advised that whatever form our revised contract took, we would agree to be bound by those terms. In other words, if we simply agreed to the County’s proposed language in order to win the bid in the hope of renegotiating the language before signing [as some suggested we do], we would agree, under penalty of perjury, that we would be bound by those terms. We were also told that depending on the changes and deletions we proposed, our score could be lowered. That placed us in a difficult position, but we decided to make our suggestions and revisions, because I could not and would not agree to the County’s proposed language-- the terms they proposed would kill the Range.

Here are a couple of issues raised by the proposed contract:
The County’s proposed contract stated we can open at 8:00am on weekdays and 9:00am on weekends. That would create huge problems for the bigger shoots we run on weekends, which require an 8:00 am start time. We requested opening at 8:00 a.m. on weekends. Without an 8:00 start time on the weekend, we faced losing a number of tournaments, which would represent a significant loss of revenue.

Capital Improvement – under the County’s proposed contract, practically 100% of capital improvements would be funded NOT by the Capital Improvement Fund, but by us. Currently, the County is responsible for all capital improvements, administering a fund that we pay into. We have paid 2% of our monthly gross revenues into this fund since day one. Currently, there is approximately $600,000 sitting in the account. I have tried to get approval for new stairs and roofs on the skeet houses, 2 new ADA bathrooms (required by the County prior to skeet houses), drainage in the room on the west side of the pro shop because it floods when it rains to be used for lounge and club registrations. I received the go ahead from the County, had engineering completed and plans drawn, pulled the permits with two extensions and they have not released the money to start the project. The money was requested almost two years ago and never released. The County is keeping the capital improvement fund that Triple B paid into. More significantly, the County’s proposed contract places responsibility for capital maintenance, repair and replacement on the concessionaire [us]. I could not agree to these terms.

Under the County’s proposed contract, gun sales are prohibited. (loss of revenue)

Currently the county pays for water, they have just installed a water meter, the new lessee will be responsible for water. (increase in expense)

Per the County’s proposed contract, the new lessee will be responsible for the outer perimeter property clean-up. That would include the bike path, 60 freeway and Rosemead Blvd. (huge increase in expense and potential liability).

Under the new contract, the County will have the right to take over the facility without payment to the lessee at any time for any length of time.

The County’s contract proposed a minimum rent increased from $3,000 a month to just under $9,000 a month. It is the greater of a percentage of gross revenue or the minimum rent. The percentages increased in some areas 400% with increases throughout the lease. Percentage rent increase goes up every 5 years. We agreed to this increase.

The County’s contract states that they also will have the ability to terminate staff and yet be held harmless for any employment related claims [like wrongful termination].

Remember this is just a few.

To recap the important information to keep in mind, we will be given a sixty-day notice. We are next in line in the event that Oak Tree and the County cannot agree on a contract.

Seems like a lot of poison pills in the county's proposed contract.

Just my guess, they don't really want a range, but at the moment they don't have the mechanism to make more $$$ from the property.

Actually, I read the RFP and was surprised that the County was pretty supportive of a range at Whittier Narrows Recreation Area. So I don’t think that’s the issue.

I am surprised the rent was as low as it has been, according to Billie. I pay almost that much for my small commercial space in San Dimas.

Whatever happens, I wish the softest landing for the Barsottis, and success for what should be a world-class shotgun range a stone’s throw from downtown L. A.

I think that biggest change we will see is that shotguns will not be sold when Oaktree takes over. Many years ago Triple B stopped selling shotguns when they got into a feud with Pacific Arms. The County had passed a law that did not allow firearm sales on their property. This is how they shutdown the Pomona Gun Show. I was told that the Range argued that their contract allowed them to sell firearms and they prevailed and they were allowed to sell firearms. This new contract will correct that grandfather issue.

Can't imagine California Gun Girls (OakTree) would agree to such a condition. They are the biggest dealer in the SoCal area.

Asking the following for a friend that has a couple of keys:

Has anyone asked how long they have to shoot their existing targets on the key?

Is the exchange (like: Trap/Skeet Key - 3 rounds of trap/skeet) for the physical key that the shooter put a deposit on?

I have about 1100 shots left on my Sporting clays and trap/skeet keys
Gonna have to shoot them off quick! Looks like we will have a 60 day warning hopefully.

I noticed when I went on Thursday, the sporting clays were kind of a mess. Some stations only had 2 presentations and quite a few were not working. Also the delay function on a couple of the stations was not working correctly, which sucks when you're by yourself.

Sad times...hopefully when Oaktree takes over they do better...

Assuming you have time available, that shouldn't be hard to do, it's 22 rounds of skeet, half that if it's sporting clays.

If you don't think you'll have time to shoot them up, invite some friends and give them a deal...

I was there today, they do seem to be letting the place run down.

I am also hoping for bathroom upgrades.

The restrooms aren't ADA compliant so when funds are released they will be upgraded.

Place was falling apart 10 years ago when i worked then. Flooded houses, non functioning machines. Filthy cafe etc.

Not thrilled that oaktree is taking over, but hopefully they improve the place.

If you read the email they state they put in for improvements, plans done and approved but no money released by the county for 2 years, the money is a 2% fund BBB puts in every year with 600k in in already...kinda BS from the county. Like they are trying to kill it

When I spoke to someone that has been right for months on the developments, the owners of Oak Tree are fully aware that Oak Tree is not really set up to be a premier shooting venue, and hold organized shoots - more for the casual and new shooters.

It is thought the owners of Oaktree have plenty of income from that range, including gun sales, so they won’t need gun sales revenue to come from Triple B Clays. I hear they are also committed to holding well organized shoots that attract good crowds.

Sure looks like they are collecting money for capital improvements...but then not using the money for the intended purpose. Cities and counties do this sort of thing with funds all the time...they can collect the interest or gains from those funds and siphon it off to the general funds. The capital is restricted to the use it is collected for...the interest is not. Common game.

The other use restrictions are just fluff...to either hammer the next tenant to pay up big time or get someone who does. Either that...or they are actually hoping nobody can come up to the demands...then they get the capital funds to use elsewhere...

I was a lobbyist for decades...saw crap like this daily...

Some clarification. I just received another email about the 60 day notice:

What this means: If we know for sure we are not getting the lease and have received our 60 day notice (which is unknown at this time), we will give you an end date to turn in your key. When you have shot your targets on your target key and are ready to turn in your key, we will be giving you targets prior to the final key turn-in. Our goal is to give our best effort to allow time for you shoot your targets.
Members & Non-Members will receive
Trap/Skeet Key - 3 rounds of trap/skeet
5-Stand Key – 2 rounds of 5-stand
