As to the "until further notice..." I'm starting to wonder if Robert's is willing to go backwards on DC v. Heller.

I believe he already has. After all, he didn't vote to grant cert in Friedman v Highland Park.

IIRC, 6 of the 10 2nd A cases before SCOTUS right now are Carry cases.

Can we get back to discussing the ten 2nd A cases before SCOTUS?

There are plenty of other threads for other topics. Or you can start a new one.

20 1/2 hours to go!

Default a thread for discussion of 2nd A cases remaining before SCOTUS post NYSRPA (Sp 2020)

Nothing on the 10, 2A cases that I can see in the orders list. This is excruciating

Default a thread for discussion of 2nd A cases remaining before SCOTUS post NYSRPA (Sp 2020)

Either someone is writing a dissent or they’re figuring out what cases to consolidate IMO. Torturous after so long.

Believe the officially re-listed cases will come out later today.

There are 10 qualified immunity cases which should be interesting too, and there hasn’t been any movement on them either

Don't know for sure, but scotusblog said nothing was granted cert. So that probably means either relists or denials.

From SCOTUSblog live blog:

@Jeffrey it's either they're going to go into July or we're in for a blockbuster end of June
SCOTUSBlog Groupie

The justices are unlikely to be doing summer school teaching in exotic locations (Austria, Italy, etc.), or attending the Santa Fe Opera. Can we expect them to extend the opinions into July?

Extending into July?

Amy Howe
That is one reason why many of us think they could extend the term into July, combined with the unusual May argument sessions (packed with high-profile cases). The counterargument, I suppose, is that they have far fewer cases to decide and they had all of March and April to work on opinions without having to get ready for arguments. We'll know by the end of the month, I suppose?

SCOTUSblog's live blog:

It seems to me that in light of the ease that 2A cases can become moot, those justices in favor of granting a 2A case are evaluating just how easy the 11 pending 2A cases can become moot. No sense in granting a 2A case otherwise.

Am I correct in believing that New York has successfully set the course of the future, and now all matters that might be eventually at the foot of SCOTUS are subject to the "Mooting Strategy", so to speak?....
If so, this could be the equivalent of Willie Wonka's golden ticket.

Or are we simply seeing an un-natural backlog due to all the virus created delays and disruptions?
So much to ponder.......

Some comfort- they didn't grant cert on any cases today. It isn't just 2A cases being delayed.

I would guess the current state of civil unrest is not motivating them to publish a decision regardless of if its a 2A friendly GVR or grant or an all out denial.

I don't see these riots & looting (vs protests), continuing beyond this week. Trump won't allow chaos to reign and even the most sympathetic to the Left governor will be under pressure to keep cities from imploding.

IOW, these riots may have stopped SCOTUS from acting today, but I believe they will act before the end of the month.

But that's just a guess....

I feel like one of these cases may be our last chance at shoring up Heller, which is crumbing under the constant assault from lower courts.
If they don’t grant cert to one of these cases, it basically means Roberts told the 4 conservative justices, “Don’t count on me to join you in a majority opinion”.
While the political climate can change in a heartbeat, things aren’t looking good for Trump right now.
If he loses, now we are in the same position the liberals are in today with Ginsburg; praying Thomas and Alito can make it to the next republican presidency while Ginsburg and Breyer will be replaced with younger justices, for whom gun control will litmus test for getting the job.
We lose 1 conservative justice and liberals get the 5-3-1 majority, there is nothing stopping them from making “intermediate scrutiny” the law of the land and basically overturning Heller and the entire 2A in the process.

I heard Thomas was told to think about retiring in order to give Trump another pick

He may have been asked, but he said NO. Moreover, we do not need for Trump to pick a replacement for Thomas, but for one of the Gang of Four, Ginsburg being the leading candidate and Sotomayor #2. Unfortunately, Ginsburg will cling to her seat until at least the new president (assuming it is not Trump) takes office.

As the end of the month (and, presumably, the end of the current session) rushes towards us, SCOTUS can, at any time, decide to release Orders and/or Opinions on additional days. For those eagerly anticipating what they'll do with the 10 2nd A cases, you may want to monitor the calendar on SCOTUS' homepage.

Well, the calendar showed Monday as a “non-argument” day last night and today it says “opinion day”. So it appears to have been changed but...since I have not kept track of their calendar before I don’t know if that’s sop or an irregularity.
The way things seem to be going lately it would appear that everything is subject to changes though.

Yes.

I believe they did that because on a Non-argument Day (what it was, blue), means the comes into session for ~15 min whereas on an Opinion Issuance Day (what it is now, yellow), they don't. Given the changes due to CV19, they're avoiding needless real life meetings.

Just my guess.

For us, it makes no practical difference.

There was a Miscellaneous Order released yesterday, but nothing 2nd A related.
https://www.supremecourt.gov/orders/ordersofthecourt/

That's why we should check SCOTUS' orders and opinions pages everyday until the end of the month (if you want to know ASAP if anything happens).

25 days to go!
