Default Aposhian v. Barr - ATF admits no authority for bump stock ruling

In a noteworthy development, ATF’s latest court filing admits that it lacked rulemaking authority under the Gun Control Act and National Firearms Act to issue a legislative rule.

Very cool! Thanks for the read. I really appreciate this because it's not fair to the public that ATF can make or change rules on a whim. I remember the pistol brace determination, their reversal of the determination, and their re-reversal of the determination......all without judicial oversight.

Say what you will about the ATF but at least they give rulings. With CA DOJ we have no ideas what parts are legal on a featureless build.

Clark has helped a great deal to advance gun rights, for a long time.

Brought the UT non-res class to the Cow Palace many years back too. Has done good things for his ancestral homeland too. Good guy all around.

Re ATF and its rulings, is there a down side to denying them the ability to do so? ATF has made some rulings that helped us, such as the no longer "once a rifle always a rifle" going away. If ATF is found to not have that authority can folks be pinched for having done what was legal at the time? Or is this a "going forward" issue?
