I don't know if he is OLL friendly because all I transferred through him was a duck hunting shotgun.

If you promote those who don't know that they are required to collect sales tax on out of state purchases from businesses, then you are promoting those who don't know the law and who are breaking the law and you also make it easier for the CA BOE to go after those people. Is that really want you want?

What I would want would be for one of those dealers with much deeper pockets than I to challenge the BOE on their misinterpretation of the "law".

The problem is that in terms of firearms, the ownership is transferred by the CA dealer (Dealer Record of SALE). Since the firearm is coming from another business, it is reasonable to claim that sales tax is due. I don't like it, but I don't think that you are going to be able to claim that the law is being misinterpreted.

If you buy a vehicle out of state, you have to pay sales tax when you register it (with a few exceptions). Also, it is claimed that if you buy items out of state, then sales tax is due. You would need to get that overturned first before you could hope to claim that an item from a business to a CA business would be exempt from CA sales tax.

Do you mean by not collecting tax meaning to not follow the law? If the firearm comes from a private party and is an occasional sale, then sales tax does not need to be collected. Otherwise it does.

It seems a bit strange to me that you might want to find a FFL who is breaking the law as that could cause future problem for you.

This is useful information, but drive further than necessary? A more helpful guide (which some merchants have) is simply this: Enter your zip code, get the nearest FFL. Save gas and time. I'm in Sunnyvale, California, and I take a 20 minute trip up a local highway to get my tanks and battleships. What could be better? Are you awake, all you obnoxious federal warrantless wiretappers?

Sorry, newbie here and I had no idea that out of state sales (transfers) are subjected to state sales Tax. I thought that it would fall under the Internet Tax Freedom Act.

If you buy from an out of state company, you are responsible for paying sales tax (see your CA income tax form). The Internet Tax Freedom Act talks about taxes specifically to Internet sales, not taxes which apply to all purchases.

In the case of firearms, the CA business is required to collect sales tax if it comes from a business. CA BOE Sales Tax Firearms Information 495.0843, 495.0848 &295.1675.600

I hate collecting sales tax, but I have no choice if I want to follow the law. This is why I mention that if it comes from a private party and can get a letter, then I don't need to collect the sales tax.

Please take the sales tax collection discussion elsewhere! This topic had been beaten to death on other sub-forums if you do a "search" for it.

In short, end consumers are responsible for the sales tax (use tax), to be reported on their CA income tax.... but FFLs are not responsible for collecting them on their behalf (for those who did, they were acting on an erroreous directive from BOE). Anyways, start a new thread if you want to *discuss* it more.

What is your basis to claim that FFLs are not responsible for collecting sales tax? Are you an attorney? CPA? Why you do you want to make such a claim and then say that you want to end the discussion?

Gun Vault in Mountain View charges $75 for FFL purchases and $35 for PPTs. Don't know if they add up a tax for out-of-state transfers.

I don't have time to read this entire post. But I DROS'ed a shotgun today. A PPT at Reeds in Santa Clara was $35.00 . The legal limit. And they had an OLL on the rack!

One more thing. I was at Kerleys in Cupertino later that day. PPT was $35.00. They had an OLL on the rack also.

Hi,

I'm new to the forum. So, if I buy a gun from Gunbroker.com and have it shipped to a local FFL dealer - what type of fee would my dealer charge me? I know the basic DROS is $25. But I guess, there are other fees too he would charge. A dealer here in Castro Valley told me he would charge me $120 if I bought the gun from another dealer/ or Gunbroker. That seems way too high...

Has anyone done a transfer with Tunn Tavern Arms in Manteca? They advertise a transfer fee of $50 including DROS, which is a good price. A lot of the other prices listed here are higher than that. It would be worth an hour's drive from Oakland, especially since I'll be transferring 2 guns at once. Also I'll be able to buy cheap ammo at Walmart while I'm out there (no ammo at the Oakland Walmart). Any reason not to go with them?

Yup. I've done a few transfers though Lee. Painless. Tavern Keeper is a calgun member here and a good FFL to deal with in the Manteca Area (feel free to PM him). He's down the street from Bass Pro.

*So recently we have had some issues with dealers over charging us during a PPT.* The law sections PC12076,12082,12086 states that the dealer is allowed to charge 25 DROS (dealer record of sale) and 10 for each firearm on the DROS (making the first firearm 35 and each additional firearm 10)* Now this excludes handguns, a handgun is a separate DROS from long guns.* A recent transfer led me to do my homework and I ended up speaking with 2 CA DOJ agents.* Both stated that if a dealer charges more than 10 dollars for each firearm on the DROS is in violation and illegally taking your money (dealers don’t have a choice this is a state law). However if you order a firearm out of state (online), you do not fall under PPT fees, therefore subject to multiple fees at the discretion of the store up to and including tax on the firearm.* I have already reported one dealer of breaking this law, I will be demanding a full refund for the excessive fees.

I have also learned that there is not a limitation on the quantity* or frequency of Private party transfers (ppt), only an activity watch. I.E. if you transfer multiples firearms consecutively during “x number of years”, then you should be ready to get a FFL However if you just happen to sell your collection, or do a small group buy, you won’t be under the gun.

I wanted to let the members know about a bad experience I had at a San Bernardino Gun Range/FFL. I did a PPT/Trade with another person at this particular place due to Turner's SB lack of interest in doing the PPT per other party.

I traded for a NIB SW686 that when I first inspected looked NIB, but after 10 day wait I went back to pick up and it didn't look the same. The revolver looked as if it had been used/fired. So much so that I had to verify the SN to make sure it was the actual firearm. I asked the counter person does this gun look unfired to you? His reply, "No it looks like it's been fired, but not by much." I though to myself that it was probably just me and just didn't notice the first time.

When I got home I realized that they probably did use it since it was not locked and it was a gun range that the PPT was done at. Plus the previous pics I got didn't look the way I received the revolver. The other person also emailed regarding the rude service they had over there. I don't if it's just one person or the whole store. The first time seemed OK but when I picked it up the guy who helped me seemed in a rush and bothered that he was doing the paper work. Plus he was even rude to a couple that arrived right after me.

I have already sent an email to the contact info for their store but have yet to receive any response. Is there any further action that I can take or report what happened? Here is the info on the FFL. DO NOT DO BUSINESS AT THIS LOCATION!
