Exclamation New CRPA Lawsuit Challenges CA’s Handgun “Roster”

Lawful gun owners, and potential new gun owners, in California have long suffered from a clever, but quite unconstitutional, state law that essentially banned the sale of any handgun released for sale since early 2013. The result is an unjustified limit on what guns law-abiding Californians can legally purchase. But thanks to a new lawsuit filed today by CRPA, this blatant attack on “gun culture” could soon be but a bad memory.

The case, which is filed as Boland v Bonta, seeks a declaratory judgment that the law violates the 2nd and 14th Amendments and asks the court to immediately issue an injunction to halt enforcement. If successful, this suit would invalidate the state’s approach and allow law-abiding Californians access to the latest firearms technology, as they should have had all along.

Does anyone know what court this will end up in. or who the judge maybe. Has that court set up any timetable for briefs, etc. Thanks

I would be interested in knowing this as well, the roster falling is a big one here in CA.

It is a matter of time but likely will take years. CA will likely put in some new laws with similar effect of the roster once it’s overturned.

And this is a DUPE. Boland v Bonta was filed on 8-1-2022. And that CRPA notice is dated 8-2-2022.

And for the complainers. The LITIGATION ARM of CRPA is MICHEL & ASSOC. That firm has 13 attorneys. How many CURRENT 2A CASES are currently being litigated in Ca?

Look at the big picture. This is Judicial Chess on a rigged board. Not tunnel vision checkers on a level playing field.

Rather than complaining on CG about what you perceive as NOT BEING DONE.

JOIN AND CONTRIBUTE TO WHAT IS BEING DONE. BECOME PART OF CRPA.

Is David Roberti even still around?….he was an overweight fat pig during his tenure in the legislature. Mike Roos is another one who we never hear of. Cancer would be comical if it visited either.

CA will always find an alternative restriction. Only way to “win” is by moving to a free state.

I was curious as well, so according to Wikipedia, both of these degens are still around, and old. Roos has his name on two hated pieces of legislation, Roberti-Roos and Mello-Roos. What a dubious legacy.

I'm not trained as a lawyer, and I was unaware that Miller v. Bonta (currently stayed) apparently overturned Roberti-Roos. It's to the point where you can hardly tell a player without a program.

Wouldn’t that be great.
Roger Benitez may issue a ruling in the near future, but I’m sure that California won’t let that go so easily. Another decade to SCOTUS, hopefully they will take the case. If California looses, they will appeal to the King of England, or whatever bs they can attempt.
