Default AR Pistol Question

Quick question, I’m looking into building some AR pistol builds. Do lowers coming have to be “virgin” in order to be registered as a pistol? Or can I just buy a used lower that was once registered as a rifle and then re-register it as a pistol?

Unless you're an exempt person, neither is an option.

A "virgin" lower cannot be DROS'd as a pistol because it ain't on the roster.

You can't "re-register" a rifle receiver as a pistol because when built into a pistol, it would meet California's definition of a "Short Barrel Rifle."

I am an exempt person and the realm of AR pistols is new to me so I was wondering if it would be possible for me to buy and have my FFL register a lower, new or used, as a pistol.

Depends on the state.

In Maine or Arizona you just goto your local FFL and purchase the same day once you pass the NICS check and Maine State Police check. Arizona it's just as easy. You can even do trades face to face with no FFL. Oregon included. Should be about 10 mins top. We don't have stupid rosters or any of that noise.
I am responding because calguns has folks from all over the US and California laws only apply to one state.

Groovy, in that case it would be much better for you to purchase a complete AR pistol. That way you avoid any potential PC 32000 issues if you build your own from a lower.

I'll let the FFL folks chime in on our ability to purchase a lower and register it as a pistol, so far as I know, you can do that as an exempt person, but I'm not an FFL holder.

For California law, under pc17170, once a receiver has been used for a rifle, attaching a short barrel to it (even without a stock) makes it an unlawful SBR.

Thanks for the info so far, it’s been helpful. Should I buy a stripped lower and finally build it, would I have to send it to a FFL to have it maglocked?

If the lower is stripped, it’s does not need to be shipped to your FFL with a maglock. Ensure your dealer will register it as a pistol because I have encountered some that will not even as roster exempt. Shoot me a dm if you have additional questions or need clarification
