Default MechTech system upper pistol conversions

I was wondering if I purchased a MechTech upper conversion kit and did not attach it to a pistol lower while in California, am I violating an assault weapon law? Is possession of an unattached upper system in California illegal? I go out of state to shoot at times and was just wondering.

I have one that was modified to a 14" barrel with stock delete.
May look into an arm brace.

The Mech-Tech kit by it self is CA legal.

If the Mech-Tech kit with a 16" or greater barrel and a shoulder stock is installed on to a pistol receiver, it would then be considered a semi-auto centerfire rifle that does not have a fixed magazine and has restricted features. Which makes the firearm into an illegal assault weapon. [PC 30515(a)(1),(2),(3)]
In order to make it CA legal as a rifle, it would need to be made into one of the following:
A. Semi-auto centerfire rifle with a fixed 10 round magazine that is contained in the firearm and can not be removed without disassembling the firearm's action or that is permanently attached in the firearm's magazine well and the overall length of the rifle being 30" or greater.
B. Semi-auto centerfire rifle without any restricted features and an overall length of 30" or greater.
C. Manually operated repeating rifle with an overall length of 26" or greater.
D. Single-shot rifle with an overall length of 26" or greater.
E. Rimfire rifle with an overall length of 26" or greater.

In order to make it CA legal as a pistol, it would need to be made into one of the following:
A. Semi-auto pistol with a fixed 10 round magazine that is contained in the firearm and which can not be removed without disassembling the firearm's action or that is permanently attached in the firearm's magazine well.
B. Manually operated repeating pistol.
C. Single-shot pistol.

In addition to all that, under CA laws/regulations... handgun -> rifle -> handgun = SBR
Which means... Once you install a Mech-Tech CCU with shoulder stock onto a pistol receiver, (while in CA) it can not be made back into a handgun or else it would be considered an illegal Short Barrel Rifle (SBR). [PC 17170(c)]




Penal Code 30515
(a) Notwithstanding Section 30510, “assault weapon” also means any of the following:
(1) A semiautomatic, centerfire rifle that does not have a fixed magazine but has any one of the following:
(A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
(B) A thumbhole stock.
(C) A folding or telescoping stock.
(D) A grenade launcher or flare launcher.
(E) A flash suppressor.
(F) A forward pistol grip.
(2) A semiautomatic, centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds.
(3) A semiautomatic, centerfire rifle that has an overall length of less than 30 inches.
(4) A semiautomatic pistol that does not have a fixed magazine but has any one of the following:
(A) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
(B) A second handgrip.
(C) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer’s hand, except a slide that encloses the barrel.
(D) The capacity to accept a detachable magazine at some location outside of the pistol grip.
(5) A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 10 rounds.
(6) A semiautomatic shotgun that has both of the following:
(A) A folding or telescoping stock.
(B) A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.
(7) A semiautomatic shotgun that does not have a fixed magazine.
(8) Any shotgun with a revolving cylinder.
(9) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that does not have a fixed magazine, but that has any one of the following:
(A) A pistol grip that protrudes conspicuously beneath the action of the weapon.
(B) A thumbhole stock.
(C) A folding or telescoping stock.
(D) A grenade launcher or flare launcher.
(E) A flash suppressor.
(F) A forward pistol grip.
(G) A threaded barrel, capable of accepting a flash suppressor, forward handgrip, or silencer.
(H) A second handgrip.
(I) A shroud that is attached to, or partially or completely encircles, the barrel that allows the bearer to fire the weapon without burning the bearer’s hand, except a slide that encloses the barrel.
(J) The capacity to accept a detachable magazine at some location outside of the pistol grip.
(10) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has a fixed magazine with the capacity to accept more than 10 rounds.
(11) A semiautomatic centerfire firearm that is not a rifle, pistol, or shotgun, that has an overall length of less than 30 inches.

Penal Code 17170
As used in this part, “short-barreled rifle” means any of the following:
(a) A rifle having a barrel or barrels of less than 16 inches in length.
(b) A rifle with an overall length of less than 26 inches.
(c) Any weapon made from a rifle (whether by alteration, modification, or otherwise) if that weapon, as modified, has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length.
(d) Any device that may be readily restored to fire a fixed cartridge which, when so restored, is a device defined in subdivisions (a) to (c), inclusive.
(e) Any part, or combination of parts, designed and intended to convert a device into a device defined in subdivisions (a) to (c), inclusive, or any combination of parts from which a device defined in subdivisions (a) to (c), inclusive, may be readily assembled if those parts are in the possession or under the control of the same person.

Quiet, is 100% correct...

I have an older model, less rail space more 80's style. I've also made some modifications on the front section of the receiver tube...



It should be noted that the bolt slide assemble, and barrel trunnion, are at the very front end of the receiver tube. Lots of real estate for accessories and issues regarding - [PC 30515(a)(4)(C)]
