Default FFL interfamilstate transfer.

is there a local FFL here in TRACY,LIVERMORE,PLEASNTON DUBLIN AREA that accepts delivery not from a FFL I have two firearms im getting from my mother and her FFL won't ship to CA in fear of braking federal law. she lives in small town of AZ and locals there are not assuring them selfs of the laws here. and I keep reading of how it needs to be from FFL TO FFL then I see threads that say she can send it to my FFL with the proper documentations. please help

She does not need an ffl to ship to ffl here. More fud. Where are you getting this fud from. What are the firearms and where are they coming from?

California does not require the sender to be an FFL. The recipient must be an FFL for a family transfer crossing state lines.

She should include a letter stating that this is a gift from herself to her son. I have seen some California FFLs that want a copy of the sender's drivers license, but I don't know if this is a legal requirement.

Elite Arms in Tracy has done interstate intra-familial transfers before. Just be crystal clear with them that this is a cross-border transfer...not one between two Californians.

Let me try ...

Federal law requires a transfer from a resident of one state to a resident of another state go through an FFL. If the gun is a handgun, the FFL must be in the state of residence of the buyer/receiver/transferee.

No law, Federal or CA, requires that the gun come from one FFL to another. That is sometimes a business requirement of a particular FFL.

It may turn out to be convenient and cost-efficient to use an FFL to ship the gun(s). The out of state FFL would have to register with CA CFLC program, https://oag.ca.gov/firearms/cflcoverview, and some of those out of state FFLs don't want to do that.

And, I'll merge these threads. Basically 1 question from 1 user.

im asking of a FFL here the will accept it. obvious not all FFL do. example SOLAR TACTIC in Livermore made it very clear to me that they will only accept from another FFL from AZ

Ok. Not all firearms dealers are on calguns. You should google the stores in your area. Pick up the phone and call and ask them. Be sure to give them all the details. Such as you are doing TWO guns and will have to wait until day 31 to do the second. You’re doing interstate interfamily transfer. Do they know how to do it. How much will they charge you. Etc.

To expand...since in my mind this thread has gotten a bit convoluted.
I have a customer whose son lives in another state.
Son wants to give Dad a "non-approved" handgun.

Is that possible and if so what's the process?

Son sends firearm with copy of his ID and letter stating gift to father tp ca ffl /Father gets hsc and does dros.

Will DROS accept an off roster/non-exempt handgun? I guess that's my real question.

Side note to the OP, check with the firearms dealer before you commit to sending anything to them what all their policies are. Like, will they release on an Undetermined status, whats their storage fee policy (if any) for guns left longer at their store than usual. Do they understand the process that you are trying to do. Just check up front.

Just gonna jump in here. The transaction type is Exempt Handgun Sale. DOJ wants you to include "interstate intra-familial transfer" in the comments box. Make copies of the out of state ID and letter stating gift and keep with DROS paperwork. That's it.

Just call the DES helpline for confirmation.

Exempt handgun sale. We keep a record of the letter showing it was a gift with the ID it came with. Letter needs to say make model and serial for us to be sufficient enough to prove this particular gun was an interstate interfamily transfer. Other than that that’s about. It. Call us if you have a question. We do these pretty frequently it seems.
