Default C&R and buying pistol out of state

Scenario; I am Ca. Resident with C&R and COE. Spending some time in Florida. Can I order C&rR pistol from J&G Sales, ship to Florida and carry back to California? Does this scenario work? Thanks!

You could pick it up there, but it is unlikely that they will ship to an address not on your FFL.

I mean he COULD ship to an FFL in Florida and pick it up from a dealer there too.

I don't think C&R Pistols have to go through an 01 outside of CA do they?

No, as long as the recipient is an 03 or otherwise authorized. But they can.

I thought about mentioning that, but decided not to because, ignoring that you are in CA, would you want to receive firearms for an out of state C&R FFL holder? I don't think I would want to, especially since it is harder to check on the status of a C&R FFL and because it is a strange request, then when you add in the CA factor, what do you think an out of state FFL would think about it?

My reply was in response to the fact that they (j&G) may not ship it to him in Florida since his 03 has a CA address on it. It was a decent work around if say he was in Florida for a month or so.

I get that aspect, but would a local FFL want to do that for a CA C&R FFL holder?

Then it wouldn't be delivery by a FFL. Also, a C&R FFL holder can acquire a C&R firearm out of state.

I can tell you that there are non-California FFL drakes who will receive a C&R on their books and then transfer it to a CA C&R FFL holder who is physically there .

I have yet to find a FFL dealer that is willing to ship a C&R firearm to a non-FFL or to an address different than the one listed on the C&R 03-FFL.

Same as using middleman FFL for California compliance work. Sellers will usually ship to any FFL.

I have a NV FFL who will accept shipments of C&R firearms for me and then he transfer them to me with my CA FFL03 when I drive to NV. This gets around the Gun Broker sellers that refuse to ship to CA and saves me a lot on transfer fees. I live close to NV I drive there once a month anyway.

It probably helped that I have purchased some C&R from this FFL so he knows me. He also advertises this middleman service for CA C&R holders who live in my area and wish to save the hassle of DROS at a CA FFL. Additionally, he has a range one can use at the back of his store.

Yes. Neither the GCA nor its implementing regulations require firearms be shipped only to the licensed business premises. Therefore, a licensee may lawfully receive firearms at the licensee’s mailing address, storage location, or other address where the licensee intends to ensure safe and secure receipt of the firearms.

Shipping to a work address so the ffl holder can safely sign for and secure the firearm, sure. Shipping to a FL address for a CA license probably not. Seems like it is more of an attempt to get around CA law.

It sounds good in theory, but how does the shipper know that the address is really controlled by the person receiving the firearm, as well that it isn't a fraudulent address for someone who isn't licensed to get a firearm? If the BATF had a means of adding additional acceptable addresses, then it would be easier, but I suspect most FFLs won't ship to an alternate address.
