Latest from "As the Santa Clara Sheriff Office Turns"

"The newly released records — a redacted index of 759 CCW applications going back to 2013 — further suggests that stature and profile offer applicants a significant leg up when attempting to obtain a concealed-carry permit in Santa Clara County".

So for those with experience, do you think it's best to re-apply? I filed in Feb and have heard absolutely nothing on the original filing or any of my followup calls (only got to voicemail) or emails.
I did add my name to the list with Michel Assoc. for CCW issues, but I'm at a loss as to how to proceed and hopefully force either a yes or no - anything would be better than complete silence

Did you submit a payment along with the app back in Feb? If so, did they cash the check? If not, I'd reapply anew. But you may want to PM JessBGuy first for his advice.

Thanks. No payment sent as per their website. JessBGuy says all existing applications were collected by the DA and she only has 8 or 9 now. I'm going to resubmit today

Thanks for sharing your GC via PM. It will be kept in strict confidence. IMO, you've got a GC that would pass in a Light Red county and should pass for Smith given what JBG has posted.

If those other 2 that JBG mentioned get issued and you do, what we'll need next is for CGNers with Yellow GC to try applying. If they get issued too, we'll change SClara on the map to Yellow and encourage CGNers with Light Green GC to try. IOW, take it one step at a time until people start getting rejected.

I recently added to the end of my CoCoCo CCW app Advice thread a post with a complete breakdown of the various GC color categories here:

If you live in SClara Co and you have GC that will pass in a Light Red county, go and apply and you'll probably be issued. If you only have GC that would pass in a Yellow county, now is the time to try. For details of what passes in each color of the map, see http://www.calguns.net/calgunforum/s...php?p=23662809)

When the next revision of the map comes out in about a week, SClara Co will be Light Red. (The map below will automatically update to reflect that.) What we need to know next is if Smith issues for Yellow GC reasons. We'll only find that out if people with those reasons apply. You'll only find out if you can get issued if you apply. If you apply, be sure to let us (CGN, baggss and/or me) know how it goes.

Giving this a New Year's bump to encourage people who have GC that would pass Dark Red, Light Red and even Yellow to consider applying with Santa Clara Co SO. Read over my first 3 posts in my CoCoCo CCW Advice thread and post #31 where I break down the colors of the map and the GCs that have a solid chance of passing in each color. So, for those who's only GC is "self defense", we're still out of luck, right?

(1) Do you ever fill up your gas tank at night and can prove it with receipts?

(2) Do you ever get cash out of ATMs at night and can prove it with receipts?

(3) Do you regularly take several guns and hundreds of rounds of ammo to and from a shooting range and can prove it with receipts and photos of you shooting said guns?

There, I've just showed that most CGNers have at least 3 more GCs than mere "self defense."

Now, will Smith accept those for issuing CCWs? Those would work if the county were Dark Green. The 3rd would be sufficient even if it were Light Green. As far as we know, Santa Clara Co is Light Red. To learn what that requires, see post #31 at: https://www.calguns.net/calgunforum/....php?t=1482924

You can do it yourself. Read all my posts at https://www.calguns.net/calgunforum/....php?t=1482924
at least once. Compare your GC to the ones I put in post #31 there for Light Red and Yellow. You should be able to figure out yourself if your GC will fly with Smith.

You can PM me if you want.

I've no direct experience with Smith/SCCSO, only 2nd hand. Most of my 2nd hand experience is with other anti counties/SOs, but they have a lot in common.

FWIW with the CV pandemic hitting SC Co hard, I doubt Smith is concerned about CCWs. Jess B Guy was trying to get her to liberalize issuance, going from Light Red to something better, but so far I've only seen some improvement. SCCSO may be Yellow now. But with the focus on CV19, who knows, they might pull their horns in.

Regardless, fewer than 12 weeks until SCOTUS decides the NYSRPA case (before July 01), where we might win some carry rights.

(1) Any news anyone? Have you tried contacting their CCW unit?

(2) FWIW ten 2nd A cases, incl 6 Carry Cases, were denied review today by SCOTUS. Don't count on the federal courts to force Smith to liberalize issuance. You folk need to organize and get active. Only 2 years until the next sheriff's election.

(3) Any news re. the CCW corruption investigation of Smith?

So in other words CCW is nonexistent here and the courts continue to treat it as a joke. Just another Monday.

I applied (for the 3rd time) in Dec 2019. Was told by the pretty and very friendly Public Relations Officer that I would hear from them in a few weeks. It's now mid June and zero response. I guess I'll try calling them too as well as dropping by the office.

Pathetic. Laurie Smith has flat out ignored multiple applications of mine for the past 6 years. Like they never existed.

Sadly, you would likely need to sue to force a response, but with the current state of affairs they could just respond with 'no'. And that would be that. Legal options exhausted.

KNTV NBC news at 11 pm tonight is running an investigative story on Laurie Smith and her "Pay to play" game regarding permits. Watch or record, it should be interesting.

Direct link... tbh, the segment was a bit of a nothing-burger, but will let folks decide for themselves and/or get in touch with the reporter for follow-up.

I went ahead and retweeted that NBC story. I suggest everyone else do it as well. At the very least we can refuse to shut up about this problem. Keep shouting it from the rooftops and make it impossible to ignore. Especially since there's now an apparent DA investigation into her.

Another thing I noticed, and this should be PARTICULARLY of interest to those who have applied for a CCW recently, is the online complaint form on the sheriffs website. I suggest that those who have applied and been ignored and denied process and denied communications begin filling out the complaint forms and submitting complaints both to IA and the DA's office. This is a system that requires making a sworn statement so use it LEGALLY and FACTUALLY. If you personally have not applied and been denied process or had your communications ignored, don't file a complaint. Those who do have standing may wish to file separate complaints for the deputies on the CCW unit as well as Sheriff Smith since her sign-off is ultimately required. Basically, be sure to name the exact names in your complaints. Again, do not file anything false or misleading.

Link (for those with standing): https://www.sccgov.org/sites/sheriff...omplaints.aspx

Thanks for this. I just submitted a complaint listing the 2 applications and the dates submitted, as well as the efforts made to contact them prior to this. Hopefully it doesn't hurt my chances as a punishment for filing the complaint

Great! I know there were a few others in this thread who had submitted recent applications. Hopefully they file complaints too.

Yet another month has gone by with no change on their CCW webpage. It still talks about a backlog caused by Peruta. https://www.sccgov.org/sites/sheriff/Pages/ccw.aspx

Applied twice within the last 10 years and was rejected for no "good cause" (Self Defense). Third application was about 5 years ago. No response or updates on that one.

That's annoying. It sounds like they were at least processing SOME peoples applications within the last decade; but even then they ignored your last one.

Would you be comfortable sharing with us what your good cause was? Either here or as a private message. I'm considering applying myself and it would be good general knowledge for what Smith deems acceptable GC.

Also, you may want to file a complaint against the department. See my post above for the details of this.

Allegations that the Santa Clara County Sheriff’s Office was exchanging concealed gun permits for campaign donations have hit the next stage.

Grand jury proceedings are held in secret, but NBC Bay Area has confirmed the assistant presiding judge in Santa Clara County empaneled a criminal grand jury at the beginning of July, and sources say the sheriff’s case began Monday.

<snip>

It's unclear if the sheriff herself is part of the probe, or just some of her top brass and members of her advisory board.

In the end, 12 of the 19 grand jurors have to agree for anyone to be charged.

“All the evidence that comes in is controlled by the prosecutor, and they bring evidence to present to the grand jury,” said Leanos, adding that there was no defense attorney in the courtroom and no judge. So there’s no way to cross examine a witness.

“They kinda get one side of the story,” he said. “Usually means there’ll be an indictment in criminal grand jury investigations.”
