Ok, for simplicity's sake, here are all of the most commonly asked questions that dealers need to know. A master thread of all of our pooled Calguns information.
#1, here is the CA DOJ FAQ. http://ag.ca.gov/firearms/dlrfaqs.php #2, here is the BATFE FAQ. http://www.atf.gov/firearms/industry/ #3, here is the CFLC FAQ (out of state dealers, it is too easy to use to stop selling to CA!). http://ag.ca.gov/firearms/cflcfaqs.php #4, when to collect Sales Tax. http://www.calguns.net/calgunforum/s...d.php?t=366781 #5, proof of residency requirements. http://www.calguns.net/calgunforum/s...d.php?t=327217 #6, how do I handle PPTs? http://www.calguns.net/calgunforum/s...d.php?t=117004 #7, how do I handle the lock (FSD) requirements? http://www.calguns.net/calgunforum/s...d.php?t=254024 #8, do I have to send my FFL to non-licensees? http://www.calguns.net/calgunforum/s...d.php?t=381561 #9, as an out of state dealer, what can I ship into CA? http://www.calguns.net/calgunforum/s....php?p=6755729 #10, what are the shipping rules in general for firearms? http://www.calguns.net/calgunforum/s...4#post10218124 #11, What are the perks of being an FFL in CA? http://www.calguns.net/calgunforum/s....php?p=6949087 For these next two answers, they are still a debatable topic. I would advise any dealer not comfortable doing either of these two things, simply not do them. The key is to create a policy and have it in writing for customers to know before hand. Communication is the key. #12, can you add long guns to a DROS? http://www.calguns.net/calgunforum/s...d.php?t=425903 #13, Can you add long guns to a handgun DROS? http://www.calguns.net/calgunforum/s...d.php?t=230841 As we decide that there are anymore questions that need a sticky, we will add them here. If you have a new question not covered here, please ask in a new thread. If it is a common one, we will reference that thread here. Thank you everyone.

Well, you asked non-FFL holders to look here, so I've got a stupid question.
How much is the DROS fee? Or more specifically, how much can an FFL charge? What additional things does he add in there and just call fees? My local gun shops all charge different amounts. And I'm not talking about transfers. For the guns they sell in their shop they each charge differing amounts. ETA: Well part of my answer is here. But that says $25. One of my local shops charges $35 and another charges $45. Again, this is for guns that they stock and sell. Last edited by MudCamper; 07-12-2011 at 8:44 AM.. |

Now they can call it "DROS Processing Fee", "dealer fee" or just add it into the price of their guns, but calling it DROS over $25 is illegal.

Thanks! ETA: I will try bringing this printout of the DOJ FAQ on the subject. I also included the rebuke to the "11 day wait". Last edited by MudCamper; 07-20-2011 at 7:21 PM.. |

Where is your link to Bill's info on Single Shot/Single Action Exempt rules? I think all FFL's should have this info.

Not to clutter the FAQ, but if you are a FFL and legally stocking standard capacity magazines (with the appropriate permit) and/or off-roster handguns, are you allowed to carry/shoot them? If you are the sole owner of the business, do the guns belong to you, or the business? What happens if you close your doors and/or let permit lapse? Are there requirements to sell "X" number of items per year? Thanks,

If you are the sole owner, the company still owns them, but you own the company. If you close the doors or let your permits expire, then the firearms must be sold. You cannot DROS non-rostered firearms to yourself unless you are LEO or the firearm is exempt in a SSE or other configuration. There is no requirement to sell any number of anything per year. I ran out of time to discuss magazines.

How about a thread for what dealers should expect from a DOJ, ATF, or BOE audit?

How about a thread for shipping questions? USPS/UPS/FedEx, shipping handguns, etc. Some FFLs think that it is required by law to ship handguns overnight.

Please start a new thread, this thread is not the place to ask specific questions, it is for the FAQ.

Under the CA DOJ FAQ it states DROS paperwork is to be kept for a period of 3 years. I don't see the BATFE 4473 paperwork storage time. Anyone know what it is?
Also I'm assuming bound books are as long as the business is open. Am I wrong? Sent from my iPhone using Tapatalk |

The 4473 is 20 years.
It appears that the bound book has to be kept or turned in.

ETA - there is such a thread, http://www.calguns.net/calgunforum/s...d.php?t=470877, but being from 2011, at least the CA part is likely incomplete.

If others are in agreement, it would be very useful to have a thread where an FFL-03 that receives unusual or unwanted and/or unmerited attention from a government agency could share their experience. Some call the FFL-03 a loophole to get ammo direct from out of state. Alternatively, the FFL-03 has gone through a vetting processing and is entitled to the same privilege as an FFL-06 in (only) this regard. Either way, should government behavior change, we would all benefit from knowing this and prepare accordingly. Thanks.
