New Mexico governor to sheriffs: Enforce gun law or resign

New Mexico Gov. Michelle Lujan Grisham signed a red-flag gun bill Tuesday that will allow state district courts to order the temporary surrender of firearms, and she urged sheriffs to resign if they still refuse to enforce it...

Some sheriffs from mostly rural areas opposed the bill in committee hearings as a violation of constitutional guarantees to due process, free speech and the right to bear arms...

Lujan Grisham said sheriffs should have the opportunity to oppose any proposed policy change, but “they cannot not enforce."

“If they really intend to do that, they should resign as a law enforcement officer and leader in that community,” she said...

“We don't work for the governor, we don't work for the Legislature,” he said. “We work for the people that elected us into office.”...

While he believes there’s no “recipe” for figuring out when discretion crosses an ethical line, he thinks publicly refusing to enforce a law on constitutional grounds goes too far...“For me, questions of this nature should be answered by the courts — not the court of public opinion.”

Richard Mack, on the other hand, says the Washington sheriffs are doing their duty. Mack is a former Arizona sheriff who in the 1990s successfully challenged a federal law requiring state officers to do gun purchase background checks. Since then, he has popularized the term that Songer uses to describe himself, “constitutional sheriff.”

“Sheriffs standing for freedom have the responsibility to interpose — it’s the ‘doctrine of interposition’ — whenever anybody is trying to diminish or violate the individual rights of our counties,” Mack says...

Mack runs an organization called the Constitutional Sheriffs and Peace Officers Association, which has offered courses in this line of thinking to law enforcement officers. Mack won’t disclose the names of sheriffs who have joined the association, so it’s hard to gauge his influence.

“It is a thing that exists,” says Mirya Holman, an associate professor of political science at Tulane University who has studied the attitudes of hundreds of sheriffs around the country. She says many are aware of Mack’s doctrine, but their adoption of those ideas varies...

So, a Democrat Gov. who has no qualms about betraying her oath to "Defend the Constitution against all enemies, foreign and domestic."

Signed a law in direct conflict with the 2nd, 5th, and 14th amendments. Says that other elected officials, that refuse to follow suit and betray their oaths, should resign.

29 of New Mexico’s 33 Sheriffs Sign Statement Against Red Flag Law

Twenty-nine of New Mexico’s 33 Sheriffs signed a statement against a red flag law, universal background checks, and other gun controls being pushed by the state’s Democrat lawmakers.
New Mexico Democrats are also pushing gun storage laws.
CBS 7 quoted Lea County Sheriff Corey Helton saying, “You’re just taking guns out of law-abiding citizen’s hands. This is not going to affect the criminals out there. They’re going to be able to get guns and they do not follow the law.”
State Rep. Joy Garratt (D) is pushing the red flag / gun confiscation law. She claims such a law would have stopped the February 14, 2018, Parkland school shooting from occurring. She said, “Had this bill been there they would have been able to remove his weapons temporarily while he got the mental health and law enforcement investigation that should have been done,”
Garratt does not mention that Florida adopted just such a gun confiscation law after Parkland, and that law did nothing to prevent the August 26, 2018, Jacksonville Landing shooting, in which three were killed. Florida’s gun confiscation law also failed to prevent the January 23, 2019, shooting at SunTrust Bank in Sebring, where five were killed.
California also had a red flag law for years, yet continues to have numerous high profile firearm-based attacks, including the November 7, 2018, attack on the Borderline Bar & Grill. Twelve innocents died in that attack...

You do realize that the Breitbart Piece you linked to is dated 10 February 2019?

On 14 February 2020, this piece stated...

In response to sheriffs who threatened to refuse to enforce the law, the proposal also says law enforcement officers wouldn’t be immune to liability if they failed to carry out their duties under the extreme risk act or other state laws...

By contrast, a similar proposal in 2019 stalled in the Senate after passing the House.

This year’s bill was jointly sponsored...

The piece linked in the OP is from 25 February 2020.

So... Most of the sheriffs objected, but we knew that from the quote in the OP...

But, the State Legislature and the Governor ignored their objections. Go figure.
