Default Utah Gov signs pro gun bill HB 114

God bless our legislature for continuing to solidify the right of Utah residents to bear arms in the interest of self defense!

Utah Governor Herbert signed HB 114 into law yesterday, which amends current Utah stand your ground law to clarify that individuals have no duty to retreat prior to using lethal force to prevent the threat of death or serious bodily. This law bars judges and lawyers from considering whether or not an individual had the option to retreat to safety in determining the outcome of a court case.

That would never work outside of Utah where there a lot of Mormons and people with manners. People are way too hotheaded in other states. Although it would clean out the trash pretty quick if CA were to pass such a law. Not a chance in h3ll though.

I believe there is something like 31 or 32 states that now have no duty to retreat included in their self defense statutes.

Just get Herbert to sign a constitutional carry bill before I move There in 7-8 years.

Carry here is a breeze. Open carry without a permit throughout the state, just need to be two actions from firing. For semi auto pistols that means you can't have a round in the chamber, but you can have a loaded magazine. Rack the slide is one action, pull the trigger is the second. A concealed permit is easy to get as long as no criminal history, $50 for 5 years, one 4-hour class for life, renewals by mail. With a permit you can open or concealed carry pretty much anywhere, including schools, except federal buildings.

Already got the non-resident carry permit. Did that a few years ago since I have three children likely to be settled there and rental properties in St. George.

Already operating under this in California. Calcrim 505, jury instructions for justifiable homicide:

[A defendant is not required to retreat. He or she is entitled to stand his
or her ground and defend himself or herself and, if reasonably
necessary, to pursue an assailant until the danger of (death/great bodily
injury/ <insert forcible and atrocious crime>) has passed.
This is so even if safety could have been achieved by retreating.]
