How to get AR (assault rifle back from Sheriff department)
Hello all, I had a temp restraining order filled on me that was made under false accusations and was thrown out. Being a law biting citizen I gave my AR to the LA Sheriff department to store (as no gun shop would hold it for me, even though one in Cerritos, said they could then told me no and offered me $35 dollars for a complete AR) Back in January 2019. Yes it is registered as an assault riffle. After the case I filed out the paper work to get my AR back.
https://oag.ca.gov/sites/all/files/a...forms/legr.pdf I final got a response about 3 months later, a few days ago. Please see attached. Can someone help me? Am I supposed to fill out this forum? And what other hoops must I jump through? https://oag.ca.gov/sites/all/files/a...cia_8016RR.pdf Last edited by spearedfishes; 08-14-2019 at 10:58 PM.. |

It seems to say you may have a criminal arrest on your record that does not have a disposition recorded. You need to get a copy of your criminal record and see what is there.
It could also be that the temp retraining order has not been cleared from your record. https://oag.ca.gov/fingerprints/record-review This is typical DOJ BS. They act like it is your fault that law enforcement and court records are incomplete, and you are a dummy for not knowing about it, then put the burden on you to fix them, somehow accomplishing it as an outsider to the system And you should have turned in nothing but a bare lower. That would have satisfied the order. Then in the worst case you don’t lose much. You also need to contact the law enforcement agency who has the gun, and let them know you are working this, so they don’t destroy your rifle. After you get your records back, someone here can help you review them and give you advice on how you might fix it. If you want to hire a lawyer to help move this along, I can recommend Jason Davis and Adam Richards. If you already have a lawyer who helped you with the TRO, you can ask them to make sure the disposition of the TRO was communicated to DOJ. The lawyer can inquire with the court clerk (you could also do this yourself). Last edited by SkyHawk; 08-14-2019 at 10:34 PM.. |

Again, people need to learn the difference between the terms 'Assault Rifle' and 'Assault Weapon'.
I'm sure the weapon in question is registered as an 'Assault Weapon', not an 'Assault Rifle'.

For future reference, anyone going through this should simply take it to a hock shop and pawn the item. Provided they would still pass the DROS to get it back. For a few dollars and not have to deal with government bureaucracy.

If the pawn shop doesn’t have an AW permit, then that no work. And I imagine most wont, because they can’t resell AW within the state. Not many FFLs in the state will deal with a registered AW, even many of those that have AW permit wont.

Reading the op made my head hurt.
Law "biting" citizen? Restraining order "filled" on him... was it cherry or lemon filling? ? Fill out this "forum"? Hopefully you spell-check the forms before sending them into LEO & DoJ.

Don't be so judge metal. Lots of people can't go to college, but you seem to take it for granite that everyone has. Maybe have an open mine and people will get a long better
