If sealed or expunged, when background are run, there is a high probability that your sealed or expunged case will still show. That is why you should always disclose all previous history.
The question on the PHS is Have you EVER been detained by law enforcement for investigation, arrested, indicted, charged, or convicted of any misdemeanor or felony offense in this state or any other legal jurisdiction (including offenses in the Uniform Code of Military Justice)? It does not ask if you were expunged or something else. even if it was expunged, the question starts with detained, investigated, arrested, which obvously occurred if your asking about expungement. Being a peace officer means that you are always honest, and that honesty must be demonstrated in the PHS. you have to realize that we are all human and make mistakes as we grow up. some of us get caught and a record follows you. the important thing you need to realize is that we understand this and take every past mistake into context. If you were busted for a stolen car at 15 and then changed you life and have your high school diploma, associates degree and your bachelors or you served meritoriously in the military, these great acclomplishments offset your past mistakes. now if you were caught smuggling weed across the border two years ago, you may have a problem right now. but that is not to say that 10 years from now you might still get hired after demonstrating a changed life be honest and let the chips fall where they may. if you are destined to be in law enforcement, you will get there. good luck. |

I do not work either unit however this is my personal experience. Word of advice, make sure you get a college degree in something other than law enforcement before you try to get into law enforcement. Without competing with other people, Applicants can fail any part of the test. Oral interview, physical agility, backgrounds for various reason (criminal conduct, bad credit, poor references, criminal affiliation, lying, poor judgement etc list goes on). Polygraph, medical ( some things you can’t control like color blindness, lung & heart complications will auto DQ ), psychological test ( you can’t control that either).
Applicant can have a good heart to be in law enforcement but that doesn’t change the serious background issues they might have, or the certain personality this law enforcement career takes to survive. Being in law Enforcement is also a lifestyle. It will change how you live your life on the job and off the job. I have worked with some really good people with some of the cleanest backgrounds, upbringings etc. from a couple of months to a couple of years, they end up quitting because the career is not for them. They had a good heart and a clean background but they were not happy and went on to totally different careers. You should always have several back up options. Wether you get disqualified, you get hired, work this career for several years or get injured and become medically retired. Oh also the poop hits the fan sometimes and you have to medically retire without finishing your 30 years wether suffering permanent injuries from an on duty fight fight, shooting, trauma with a suspect in a incident. So always have back up options especially a educational degree. Be honest with yourself and throughout the application process because there is a saying in the background process “ you lie, you die”.
