Default SB2 and CCW Insurance

Any predictions if CCW insurance will still be viable once 1/1/24 comes around.

Likely remains the same but if you used your firearm in a new “prohibited” place, they won’t cover you.

So back to square one.

Unless you use your firearm while in your car (which they could argue that you should drive away instead) or run into someone in the middle of nowhere, you won’t be covered

Insurance premiums should be based on risk assumed by the insurer in a free market. If the increase in prohimited places reduces the insured risk the premium should drop in indirect direct proportion to the increase in prohibited places and in direct proportion to the decrease in liability. This assumes there are sufficient insurers bidding for insurers so as to create an efficient market. ie. If prohibited places are increased by 20%, liability risk decreases 20% and that should cause a 20% premium decrease.

Should be an injunction against SB2 at some point right?

The other states that did similar this is what happened I read somewhere.

Are you never going to carry in another state (either on your CA permit or another state's)? The insurance is still a good option

Spoke with someone at CCW Safe today on another matter and then asked about coverage if incident is in a prohibited place as defined in SB2. I was told that they have partially covered others in similar places/situations where there was a proper defensive shoot. However, the firearms charges and locational charge fallout issues were not covered.

Bottom line - some coverage is better than nothing but with the potential ambiguity of where exactly many prohibited places are, the CCW holder is at risk with a diminished coverage shield.

I was looking at USCCA policy the other day, even without SB2 it seemed of questionable value - given they say their coverage ends if you are convicted of any crime arising from an incident. Considering DA can throw everything at you (including noise laws), you could easily be guilty of something innocuous and suddenly you have no insurance.

Add SB2 to that and I'd be surprised if any insurance is worthwhile

I just signed up for Attorneys on Retainer. They specifically state you are still covered, even if in a gun free zone, among many other things. They aren?t backed by an insurance company, so they can actually cover you if you are charged with a crime.

Isn?t SB2 insurance requirement more about liability to pay others if have a shoot? Not about CCW insurance that covers your legal fees if involved in a shoot?

Where do you see that in the SB2 text? I read the entire bill and saw nothing regarding having to obtain insurance.

Has anyone else here seen this? If so, please copy and post the exact text.

ETA: I just read the bill again and there is no statement regarding a requirement to obtain any kind of insurance.

However, according to SB-2, there is nothing preventing a local jurisdiction from passing laws more restrictive than SB-2. Given that, a local jurisdiction could require some form of insurance.

The real question that should be asked is when CA is going to ban CCW insurance. Some states have already banned it.

That's why I got a monthly CCWsafe plan instead of paying for a year at a time.

Sorry my bad. Insurance is not in sb2. I conflated the thread title and the recent San Jose and another bill pushing insurance for gun owners.

Actually, some of the states probhibiting this is because these are NOT insurance programs even though they are being touted as such.

^^^This! As of September, all members also are covered for CIVIL litigation representation if you?re sued when using your gun legally!

And yes AOR (Attorneys On Retainer) aka: ?Attorneys For Freedom? will cover you if you used your gun in defense or defense of others (basically don?t use it to hold up a Circle-K) even if you?re in a ?prohibited? zone.

They also represent you in all 50 states!

If you want ?training,? then I?d suggest one seeks it somewhere other than from an insurance based program like USCCA and the other places that will CANCEL yer azz, just for being in a ?prohibited zone? that you weren?t even aware of.

For me, I want a CRIMINAL and CIVIL lawyer first and foremost and from a law firm, not a damn insurance company who?s sole mission in life is to find ANY reason to NOT fulfill your claim.

AOR is the best?. No, let me rephrase?. AOR is the ONLY option now for Cali and with SB2 coming into effect.

I've had a few lengthy conversations with Mark about the program and he's the real deal. Cool guy, approachable and responsive. You just need to cover things until your case is deemed a felony as they don't work on misdemeanors. They will work on misdemeamors for a fee however their program doesn't kick in until a felony is charged. Permitted or not they cover. IMO the other insurance companies are a waste of money and a false sense of security in many cases.
