Can she use her 5 PPT's per year to DROS firearms registered in my name? I believe it is legal since the seller does not matter only the receiving buyer. Am I correct to assume this?

Trying to get fund together for a Nemo Arms .300-win mag but only have one DROS left. If I use hers, I can get the funds by selling many others I don't need right now.

My cousin sold me two of her husband's guns after he was gone.
She had the paperwork, but no one asked. The answer I have seen here many times is that it has been done often, never heard of a problem.

One must distinguish between 'is it legal?' and 'am I likely to get away with it?'
While CA is a 'community property state', that does not work cleanly with firearms; neither Feds nor CA have any way to register a firearm to more than one person. A couple may, quite reasonably, consider all of the guns as jointly owned, but there's no legal mechanism for that. So, since formally the other spouse is not the owner, the question is 'can someone legally sell something they do not own?' and the technical answer is "no". There are things like Powers of Attorney for that, but no help here: that would still be the husband selling, using wife as agent. Two things contribute to 'I will probably get away with it': as already noted, in a PPT the owner is not yet checked, as many guns are still not 'registered', nor are they required to be registered in 2022. And, in this case, the actual owner is not going to complain.

There is also the view that the staute limiting the number of DROS transactions in a year is uncontstitutional. Based on the number of people on this forum apparently doing more than five transactions per year, it does appear that law is not enforced. Nor after Bruen could it be.

You’ll probably have no issues about the 6 a year. I know many that sold 25 a year to thin out their collection. The key words are UNLICENSED GUN DEALER.
if you’re a collector or hobbyist you’re good. Anyone can be the seller. My uncle passed and I just sold off his big collection of 27 handguns over a few months. Nobody asks. The wife can sell, your daughter, the homeless guy on corner if he has a California ID. I have read some funny for sale threads where the seller won’t take an order until January…..hahahaha. Way too Anal and probably an INCELL.

True. That seller could always claim they just moved to CA I suppose. If PPT is not blocked though, the pistol is sold though. Something to be weary as a PPT buyer I suppose

I'll share a finance story
One firm i worked for enabled employees to give $100 credit to a customer to cover annoyances.... It was easy 3 years later one of the telecom project managers made a search tool for the credit system I could search by employee and see / sort all credits I could sort by customers to see if anyone has leaned to complain to get the $100 The result was several people got written up and some terminated. They would give their roommate or girlfriend/ boyfriend / parent $100 a few times a week. Why do I share this... well we know BATFE is illegally copying FFL books We know batfe build a National registry from every closed gun shop The pistol you picked up in 1985 at Gemco, well the buy paperwork might already be in the federal database. In 2 years In 5 years In 10 years will someone search PPT sellers vs the purchase records? You can do an interfamilial transfer to your wife for a few bucks. Yes spouse needs the guy buyers test and card. I would be more inclined to register 10-15 to wife and then follow the ppt laws. Or chat with an FFL to see if they want to make a reduced 10% to sell your off roster high ca dollar stuff! And 20% for on roster stuff. Many shops are tight on cash - your inventory costs them nothing. Buying 10 Glocks, they tie up $4,000. Sell for $5200 over time. Now they can have stuff to sell that does not tie up their capital. You can also post the listings here to help drive traffic to the FFL (if allowed) by Calguns.
