The feds and cops can have your cell phone mic turned on oven when the phone is off. They can also turn on your onstar. Both have been proven in court. Get this, you have no expectation of privacy if they turn on your cell phone mic after you power down the phone unless you are in your attorney's office in an official meeting.
No warrant needed and no attorney client privilege. Scary times.

Law enforcement agencies have been capable of remotely listening to your phone's microphone even when the phone is off for around a decade now, not sure why you guys are acting surprised. Here's an example of what the FBI was able to do with old phones in 2006, I imagine that they have much more advanced techniques employed with today's smartphones.

The court and the LEA both said they knew that the owner of the car was not the suspect and was never under suspicion of being a criminal. The owner of the car just happened to give the person they were after a ride once in a while.
