So he can get off with no charges then go acquire another one when it's convenient? I think I get what you are aiming for in that it would take the threat of imprisonment away, and thus the motivation for shooting it out. But someone like this is rarely only going to have only one thing they could be charged with, i.e. the gun.

We could avoid all possibility of violent encounters if we gave criminals an "all come free" pass on everything if they come clean. No.
