View Full Version : Will ther be an upper ban as well?

I'm saving up money and will turn 21 in april, my question is. Should I buy an upper(already have a lower) or purchase my desired 9mm (glock, xd, kimber, or beretta)? I know it's a dumb question but it doesn't hurt to ask, Thanks?

I don't have crystal balls, either, but I take cues from the last Senate And House bills that BOTH ban military style rifles AND the "parts that can be used to construct them."

Anyone who thinks the AG and folks at Brady aren't hip to the OLL movement will be badly surprised.

Wouldn't the current situation in California count as judicial precedent (or whatever the proper legal term is) to show that a firearm cannot be banned based on the "Style" of weapon?

I'm sure if Obama gets enough time, the Democrats in Congress will try to reinstate an assault weapons ban, and it may happen. But if they were to try to ban "military style rifles," they'd be sh*t out of luck in my book.

On the one hand, just about every bolt action rifle ever used, and some shotguns, have been and currently are used by the military; however they remain available in their civilian form to everyone at their local gun store.

On the other hand, the fact that a California gun ban was overturned because it banned guns by style is a decent enough indication to tell me that "Styles" of weapons will not be banned. Although, just as here in Cali, guns may be banned by make/model, and by "evil" features.

Not trying to be defeatist or antagonize anyone, just my two cents.

Also, banning an upper is akin to banning aftermarket barrels for shotguns...kinda. It would be like letting someone buy a firearm and then telling them that they cannot modify in any way. "If I buy a Cadillac, it's mine, I own it. If I wanna paint it, I'mma paint it..."

49 other states don't care about OLL because Roberti-Roos doesn't apply to them. So there is no "list" to be "off" of.

Secondly, the upper is not the rifle, the lower is. You can have an upper shipped directly to your door, no ffl required. Even with the 94 AWB in full effect, rifles continued to be manufactured, they just couldn't have any of the listed features.

Obama is already under the microscope, and I think we forget that 1 out of 4 houses owns a gun! Its going to take a little more then the Brady Campaign to stop us! I dont have a crystal ball, but I do know that I would not sit there, and let them stop me!

It would be really hard for them to stop you buying an AR-15 upper in a private sale. I can guarantee you that there are people stockpiling uppers just to sell one to you after a ban. It might cost more after a ban but how much is one priceless rifle worth?

I would buy all lowers and wait to get a pistol. Or get one cheap upper and spend any money that's left over on more lowers. How much would two priceless rifles be worth?

A cheap CMP Garand might be a nice investment too. It's about the cheapest semi-auto rifle chambered in a real ~long range man stopper caliber. I bet the anti's really want to shut down the CMP.

Any way, the reason why the series type ban went out the window in CA is that the law was poorly written. If they get the right words they could make a ban that would survive the type of legal challenge that we used to get OLL's. A well written ban might not be able to survive a constitutional challenge but it might take a long time to get to that point.

I'm pretty sure that the anti's are smart enough not to shoot themselves in the foot with a ban that will fail a quick legal challenge and lead to shall issue CCW nation wide or something like that but they will do something to make it look like they are trying.

They might be able to ban the manufacture, but because they aren't serialized, how would they stop ppt?

Dude, whats there to be afraid of? I already have a Beretta96(.40) and also use my dads Ruger p345(.45) and Smith and Wesson revolver(.44 mag) I'm gonna get a 9mm, thanks! Oh and not to mention my AK-47 and AR-15, I'm not afraid of shooting guns.

YES PANIC BUY , they will ban everything, beer and porn next. Except for the white collar thieves, they will be encouraged with a stimulus package. When will it end, someone here posted something remarkable , that the shortages started after the elections, strange from one day to another MMMMM. Thanks again for speculating, raising the prices and in a weak economy by defacto limiting people from enjoying the hobby.

I look at the bills that failed because Dems didn't have enough votes -- don't say that means they will not rear their ugly heads again -- we just saw them pass a hugely unpopular bill with a feeling of impunity -- and every schmuck who says "last time we made them pay at the polls" should have voted in the last election when an openly anti-gun president took power.

The passages that are of interest:

(37) Conversion Kit- The term `conversion kit' means any part or combination of parts designed and intended for use in converting a firearm into a semiautomatic assault weapon, and any combination of parts from which a semiautomatic assault weapon can be assembled if the parts are in the possession or under the control of a person."

Any parts. That means barrels, uppers, LPKs that can be used to make a Semiauto

If their intentions are not clear enough:

A semiautomatic rifle or shotgun originally designed for military or law enforcement use, or a firearm based on the design of such a firearm, that is not particularly suitable for sporting purposes, as determined by the Attorney General. In making the determination, there shall be a rebuttable presumption that a firearm procured for use by the United States military or any Federal law enforcement agency is not particularly suitable for sporting purposes, and a firearm shall not be determined to be particularly suitable for sporting purposes solely because the firearm is suitable for use in a sporting event.'.

anyone that thinks Heller will stop a Bill like his hasn't read Heller well enough, or been paying attention for the last twenty years. IMO, don't panic buy, but running out and getting 20 lowers MIGHT come back to bite you in the ***...

I don't know what you "vend" but I do not vend FUD. FUD has no basis in fact. You don't want to know what's coming so you can fight it? Fine. We just saw how well THAT works.

What does the stimulus have to do with this conversation?

What "fact" was your post based on? A bill that never had a chance of passing? A bill that still doesn't have a chance of passing?

I'm happy to know what's coming, but that doesn't happen by running straight into panic mode as soon as some anti-gun politician sponsors a failed AW ban for the 6th time.
