Default Man successfully argues the Fifth in deer killing case

"In central Pennsylvania, a farmer apparently has won an expensive constitutional argument over his Fifth Amendment right to evasively answer a game warden’s questions about a recently deceased deer.

The AP says that Jack Coble, 60, of Perry County, Pennsylvania, spent thousands of dollars to make a constitutional point about a $150 fine he received after he declined to give specific answers to a warden who was on Coble’s property.

“There’s no exception for the Game Commission under our Constitution to give them any greater police powers or less police powers than officer Joe Smith, walking the beat,” Zagurskie told the AP. “It’s so odd that that persists out there, and I think they believe that.”

Default He had to front the attorneys fees and get reimbursed later

My understanding is that if you have a civil rights case, the court orders reimbursement if you win - that is probably what happened since he won - he just hasn't been reimbursed yet by the government for his attorneys fees.

One problem I see with this is that you will always receive a ticket. You will never be let off with just a warning if you use these tactics. (This is in regards to being pulled over for speeding - following the link to the video.)

I would say majority of the time you will be receiving the ticket any how..

Regardless.. Police should be more then happy to see people exercising their rights. They take an oath to protect and honor those rights.. one would think they would appreciate them being used more often.

There are thousands of police out there that applaud the exercising of ones rights. Those police don't always make it on youtube , but occasionally they do and we have seen some of those videos.

Kuddos to the man for winning his case in PA.
