Default Pot-related question

Hello Everybody :

I live in a very decent area in East Modesto.
We have almost ZERO issues simply because of the nice mix of
middle class and working families.

Yet, it has been three days ago when I get back from work at the evenings
and smelled a really strong and nauseating pot odor around my house.

What are my legal limits and my rights when it comes to this situation
especially knowing that I don't know yet who is growing this plant.

Any recommendations please.

If you are a civilian, you have far more latitude than an On/Off duty cop. If you're sure they're growing it, get as many details as you can without getting yourself embroiled in a neighbor dispute. Also be aware of trespassing laws. Keep a log of activity (coming/going) and get license plates if you can (again without compromising your safety).

Then contact your local agencies Narco crew and give them the info.

Im not a LEO, but you gotta be aware that A LOT of CA residents are legally cultivating/using medicinal marijuana. Just something to think about. There are laws that protect you, but if someone is growing/using on their own private property, I doubt you can do much about it.

#1 thought- keep yourself safe

If someone is growing a lot of plants then the DEA might bother with the grow.

Around Maryville I have heard about people getting licenses to grow upwards of 50 plants and the local PD allows it under prop 215

A friend hates where he lives as his neighbor is a grower / dealer.
Neighbor has plants in the backyard that reek.

So he called the cops. The cops verified that the grower had an RX attached to each plant and was not "unsafe" and not stealing water or power. They left the grow alone.

My friend is now debating a camera system to document the traffic of buyers coming to the home.

The grower claims that all is given to a co-op dispensary and nothing is sold by him.

My joking suggestion was for my friend to grow his own pot. Let it go to seed. Let his plants- male and female- allow all of the other drug dealers plants to get pollinated and bud seeds.

The difficulty is, if your neighbor is a dealer and he discovers that you're the one notifying the police about him... well things could get very ugly and very dangerous for you. So most of all, you need to be discrete.

Probably the only way to get it shut down is to document in a logbook all the visitors arriving at your neighbor's home: date, time, vehicle make, model, color, license plate # (if you can observe that discretely), number of people, appearance, how long they stayed, etc. If there's enough activity, then it strongly indicates that the neighbor is a dealer. Then call an anonymous tip line and report him with the collected information.

Here is the real truth.. Your neighbor is most likely growing it legally. Your only hope is Modesto has an ordinance prohibiting outdoor grows, many other cities and counties have gone this route. Bottom line is, dont get yourself involved. Call the police and give them the address and let them handle it.

Guys:

First and foremost, thank you very much for your inputs, it really means a lot
to me.

I don't seem to understand WHY would any law allow people to plant POT in
a densely populated areas. But hey, just like gun control, for the sake of ONLY
one sick man ( crazy shooter or pot grower ) a whole nation or community will
have to pay the price.

I don't seem to notice any unusual activities yet, but am not sure what time of
the day DO these activities take place. Anyhow, I instructed my folks at home
to be on watch and NEVER open the door for anyone.

The cop that patrols our area is my friend and I will have to talk to him regarding
this matter and hopefully he knows more about what is possibly going on.

Again, guys, I really appreciate you all.

Call your PD (or SO) and ask if they have to get connected with whoever investigates marijuana grows. Many agencies receive grant funding for at least one detective to investigate grows and 215 compliance. If they have no one and the grow is big enough, there are multi agency teams like MAVMIT who might investigate it. Also, if they are renters, find out who owns the property and let them know. Got rid of neighbors grow as they had a no marijuana clause in their rental agreement.

Good luck, it is only going to get worse for us non-mj folks.

And you can't tell where the smell is coming from. Most likely if it is as strong as you claim it is an indoor grow and you are smelling the vented air. Give it a few weeks and it will probably go away. Also since it is most likely a legal grow, your best bet (if you can figure out which house) is to ask them nicely to invest in some carbon filters, chances are they are so used to the smell they don't realize it is bleeding onto your property. Orrrrrr myofb since if you lived next door to Ben Franklin you would've probably smelled something similar.

Honestly guys, I have never ever seen or touched or smelled or
smoked in my entire life, and thanks to internet pictures I was able to know
how it looks like.
The odor is so strong that I had trouble sleeping
the first night from bad headache and dizziness.

If the smell of plants growing next door causes you dizziness and headaches you should see a doctor. If they had a compost box and were growing tomatoes, would the manure smell have the same effect?

I have seen the damage caused to houses by indoor grows. If the people don't own the home, contact the owner and let them know what is going on.
Either way, contact the city code enforcement office and see if there is something that they can do about the odor. Just because it is legal to grow doesn't mean that they can violate other city codes or ordinances.

Is it a forum for people that are charged upholding the LAW? Because the LAW in California allows people to grow medical marihuana. As much as you may not like it. The LAW that you SWORE to UPHOLD. Says his neighbors are probably a ok.

Just because there is a law making it OK, doesn't guarantee his neighbor is within the law. If he is, then he should have no problem if the law visits.
