If you have BOTH a C&R 03 FFL and a Certificate of Eligibility, you can buy any number of handguns in a 30 day period and are not limited by Penal Code §2753.
I have done it myself more than once this year. Here's the part you should write down or print: There is a popular misconception that such purchases are limited to C&R handguns. That is incorrect. The law does not make that restriction. The text of Penal Code §27535 (was 12072(a)(9)(B)) is: (a) No person shall make an application to purchase more than one handgun within any 30-day period. (b) Subdivision (a) shall not apply to any of the following: ... (9) Any person who is licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, and has a current certificate of eligibility issued by the Department of Justice pursuant to Article 1 (commencing with Section 26700) of Chapter 2. The CA-DOJ appears to believe otherwise, but the PC, as you quote, is entirely clear.

C&R FFL Info here.
CoE Info here (post #2). It doesn't take a lot of money, patience or paperwork to get these licenses. Don't feel intimidated. It's easy, quick and cheap.

Will this 03 FFL/COE combo work for transferring multiple guns from an out of state parent/child? That is, can I make an INTERstate INTRA-familial transfer of (off roster & on roster) multiple handguns? I will bring in the guns personally in to the state. No shipping required. From what I read, INTERstate INTRA-familial are limited to 1 per 30 day but hoping the 03 FFL/COE combo would allow more than 1.

I expect you already know your C&R allows getting C&R handguns, and all you need to do is report them, no FFL required (besides your own C&R). But it does appear that the C&R + COE combination should exempt you from the 1-in-30 on non-C&R handguns, interstate transfer or in-state. Intrafamilial would exempt you from the Roster - but interstate intrafamilial cannot be purchases, the guns must be gifts.

I don't have C&R or COE - yet. I was wanting see if that would allow me to go to my dad's and bring back 3 guns in one trip. This would not be a purchase but could I pick it up from him?

If the guns from your dad were C&R guns, a C&R license would allow you to retrieve them from him, from out of state back to CA, according to that license.

Sneezy - He could bring them to California but they would need to be transferred to you by a California ffl.
All firearm transfer between residents of different states must be done by a ffl in the state of the new owner. |

Did you see my post in the FFL forum a couple of days before you posted this?
Some FFL's are not versed in this process and it is a learning experience for them. Anyone looking to use this exemption make sure the FFL enters in 1-in-30 exempt and choose licensed collector with current COE. If the DROS is run any other way it will be rejected!!! |

Thanks for the good info!
It was confusing trying to combine the 2 sets of special rules. One more question, could the 3 firearms be shipped to a CA FFL instead of my dad bringing in person? He may not want to do bring in person. |
