Default Take Action to Oppose CA-DOJ’s Proposed New Rules for DROS

Tomorrow – September 24, 2013 – the California Department of Justice will be holding a public hearing to accept public comment concerning DOJ’s proposal to add regulations affecting the Dealer Record of Sale (“DROS”) program, including the fee associated therewith. Our office, on behalf of the NRA and FFLGuard will be submitting a letter with three main objections, in no particular order:

1) The proposed charging of an extra $25 if the FFL fails to designate a transfer of more than one firearm as a multiple-firearm transaction is not justified (they are already charging too much with the first $25), this cost will surely be shifted to firearm purchasers, and there is not statutory authority for doing so;

2) Proposed Section 4230 prohibits allowing FFLs from delivering a firearm to a purchaser unless their DROS is "approved" – this is a significant expansion of the statute for which DOJ does not have authority. It is thus not a proper regulation, and seems to be an attempt to moot CGF's Schoepf lawsuit re DROS delays.

3) The expected savings of $5.2 million will be allocated to fund the APPS program, which should not be the DROS Fee's primary purpose. It seems that all money DOJ takes in from the DROS Fee goes directly to APPS instead of core DROS program purposes. DROS Fee payers should not be the sole and financiers of APPS, at least not without their permission.


Those who are able to attend the meeting in person, are encouraged to do so to express their concerns and disagreements with the proposed regulations. The meeting will take place at 1:00 p.m. at 1416 9th Street, Sacramento, California (the Department of Water Resources Auditorium located).

Those who are unable to attend in person are encouraged to submit their comments in writing (via e-mail or letter) to:

The issues you raise in #2 also violate due process without DOJ having an obligation to make a final determination within a set period of time, as well as a defined appeals process. One cannot remove rights by inaction.
