Could it be that expanding what is defined as "hate speech" could be used as a reason to have targets declared dangerous by mental defect due to what is devolving into an ever expanding definition? Laws being sought to grant seizing of firearms without due process would then come into play after one is declared a dangerous hater. It's a stretch, but this is how it starts.

First they held that corporations are people, money is speech so they can spend as much as they like on political ads. Considering that corporations own all the cable news channels, What can go wrong with this?
Then they held that closely held corporations have freedom of religion but people do not have freedom from religion.

Corporations win win win.

I never suggested they are compelled to do anything. It has been an appropriate time for a ruling AND now that there are other very significant rulings based on O'Scannlain's opinion it provides greater peer support for his reasoning. Judges do care about how their opinions are received, just like other academics care about their published pieces and how their are perceived by their peers.

Anyway, with a directly supporting case in an other circuit extensively citing Peruta and using the same logic and history to reach its conclusion it becomes somewhat more accepted as "the result." Use the ca parison of a scientific theory. If one scientist postulates a cause for something and is able to make predictions based on his theory great, you have an idea. But when other scientists start adopting this theory and they craft predictive experiments around it you have a much stronger foundation. This is what I see here.

I believe that the Palmer decision makes it much less likely that the circuit will take the case en banc and if that is the case O'Scannlain is more likely to go ahead and grant Harris intervenor status and deny rehearing. He has not forgotten what happened in Nordyke.

This means we are much more likely to go to SCOTUS from the victor's seat rather than trying to reverse a bad en banc decision.

Another significant difference is that since we are a "May issue" state and The decision only challenged the as applied policies there is already the infrastructure to implement the decision and licenses can be issued tout suite. Unlike in D.C. There is no viable excuse for an extended stay pending appeal. There is also a procedure for revoking licenses as the OC sheriff confirmed when she was first elected. This means there is no permanent damage in issuing the licenses.

In short, Palmer will give O'Scannlain the incentive to move forward, the en banc panel incentive to pass this on up to SCOTUS, and there is every hope and expectation that once there is movement we will see "self-defense" accepted across CA as good cause. (Except the stragglers who will need legal persuasion.)

The "infrastructure" is actually *not* in place yet. We do have a system, but we lack the capacity. Only when our system can handle 5%-10% of population without significant delays will we have the true infrastructure.

We can achieve this by adding personnel, or by getting rid of irrelevant, but time consuming nuances.

Agree with the rest of the post completely, though...

The statutory infrastructure is there. But, as you point out, the fact that virtually all LEAs in California hate us/2A makes for slow/delayed processing by operation of their chosen local rules.
