Default 2013 CA SB 374 - VETOED OCT 11 -Steinberg - Firearms: assault weapons

5/29/2013 - passed Senate 23-15, sent to the Assembly.

Defines any semiautomatic, rimfire, or centerfire rifle that does not have a fixed and the capacity to accept 10 rounds or fewer as an assault weapon.

Existing law regulates the sale, carrying, and control of firearms, including assault weapons, and requires assault weapons to be registered with the Department of Justice. Violation of these provisions is a crime. Existing law defines a semiautomatic, centerfire rifle that has the capacity to accept a detachable magazine and other specified features and a semiautomatic weapon that has a fixed magazine with a capacity to accept 10 or more rounds as an assault weapon.
This bill would, instead, classify a semiautomatic, rimfire or centerfire rifle that does not have a fixed magazine with the capacity to accept 10 rounds or fewer as an assault weapon. The bill would require a person who, between January 1, 2001, and prior to January 1, 2014, lawfully possessed an assault weapon that does not have a fixed magazine, including those weapons with an ammunition feeding device that can be removed readily from the firearm with the use of a tool, to register the firearm by July 1, 2014. By expanding the definition of a crime, this bill would impose a state-mandated local program.
This bill would require, on and after July 1, 2014, a Firearm Ownership Record to be submitted, as specified, to the Department of Justice for every firearm an individual owns, with prescribed exceptions, including firearms purchased from a licensed firearms dealer and documented by a Dealers’ Record of Sale transaction and assault weapons registered with the department. The bill would authorize the department to charge a fee of up to $19 per transaction for the submission of the Firearm Ownership Record.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that no reimbursement is required by this act for a specified reason.

Why 80% lowers? This will ban everything from AKs and ARs to 10/22s as assault weapons.

Negating the law by refusal is better that complying when the law is this broad. Any semi-rifle that accepts a magazine will be labeled this way and as such will be subject to the laws and regulations of RAWs that are owned by people now.

Its unreasonable and unethical for any 2A supporter to comply with this law if it is passed.

I was going to make some chuckle about the M1 Carbine being an assault weapon, but then I found an even better victim.

If I've read Steinberg's bill correctly, the MARLIN MODEL 60 would be an assault weapon. Christ.

is it 19 bucks per gun or Firearm Ownership Record? that could be very expensive,and a very convenient list for the next phase of there plan: Confiscation .

Why an obscure number like $19? I have to imagine it comes from the billwriter's sales pitch to raise the state X number of dollars. X divided by "projected number of firearms in CA to be registered" equals 19.

Isnt the Marlin 60 okay cause the magazines is fixed? Or am I reading that wrong. Neverming fixed and capacity to accept.

Have this enact at the end of this year have Bontia(sp) bill start some time after which eliminates grandfather clauses. You now have a record of all firearms that can be seized.

And next, lets end the whole registration leads to confiscation hysteria and the absolutely absurdity that you lost your guns in a boating accident. If you are not 100% committed to the fact that if they come door to door for our guns, that this time has not come then I suggest you sell all of your guns now and join the liberals today so you can continue to live comfortably in bondage never having soiled yourself standing next to those patriots that will.

If they come for your guns, it is time to use them. We still have a fight left in the legislature. We still have a fight left in the courts. If they succeed, do not comply, but prepare for your chance to finally walk the walk and fight for your freedom. Make no mistake about it, if they come for your guns, anyone advocating hiding is not on the side of liberty and definitely not fulfilling their duty to establish a new government.

I am not a radical, I am history teacher. Read that link to the Declaration of Independence above. This concept is as old as John Locke and the foundation of our nation. I think some of you need to remember that and you most certainly ought to start telling your friends about it.

Let's fight them in the legislature so we don't have to fight them later. Get to it.

Some language and punctuation in this bill was either inadvertently, or perhaps purposefully, confusing. On first glance, it appears to affect only semiautomatic rifles, whether they be rimfire or centerfire (lovely; my 10-22 is an "assault weapon". HAH!!!). Read it again....

"This bill would, instead, classify a semiautomatic, rimfire or centerfire rifle that does not have a fixed magazine . . . . "

Read a different way, the bill would apply to semiautomatics AND rimfires AND centerfires that do not have fixed magazines. In other words, any firearm with a detachable magazine, regardless of type of action, is an assault weapon.

Hey, you hunters who don't care about this because you can still have your unregistered bolt actions; take notice. The language in the bill classifies your bolt action rifle with a detachable magazine as an assault weapon.

The intent is clear. The majority of people are not going to even know this exists, compliance will be low, just like the last ban. From then on, any unregistered gun gets taken.
