Hope you are not given the run around once you have the paperwork in order to get your gun back. Best of luck.

Sure is sickening that these scum bags get off with only probation. We need some steeper penalties in hopes of making some of these crooks think twice before breaking into someones home.

The processing fee for a Law Enforcement Gun Release is $20.00 for the first firearm (long gun or handgun), and $3.00 for each additional handgun being
reported (e.g., 1 handgun and 1 long gun = $20.00; 2 handguns and 1 long gun = $23.00). If the agency or court determines the firearm was reported stolen
pursuant to Penal Code section 33855, subdivision (d), the fees for the stolen firearm(s) will be waived.
Provide documentation from the agency
or court
with this application to qualify
for the waiver of fees

. DOJ will process your application within 30 days from the date of receipt unless delayed by
circumstances beyond the control of the department.

I'd like to know that too. I doubt it is.
Unfreaking believable that this is how they enforce current laws and at the same time they are trying to pass 50 new gun laws.

Well since my gun was stolen the fee is waived, im trying to figure out what documentation is needed to be sent with the LEGR form.

What I heard was that that guy had a juvenile criminal history but this was his first adult offense.

Really glad for you brother!

Definitely appalled at the fact that three years probation is all the scumbag received. Heck, I'm sometimes concerned with uneducated LEOs or Rangers while using my perfectly legal OLL AR on BLM land, yet this bastid can be caught with a stolen firearm and just walk away?!! W O W ! ! ! !

Not that there is a silver lining, but this does make for a pretty compelling "good cause" statement.
Your house was burgled by gang members and they were caught but not given jail time. You feel your life is in danger since they obviously know where you live.

People need to contact their legislators to overturn this prison realignment legislation (AB109). It's only gonna get worse.

The only saving grace is that he will most likely violate probation repeatedly and serve longer in county jail for that than the burglary. Glad you got your gun back.

Sent off DOJ form Tuesday, waiting for the OK GET YOUR GUN form from DOJ, then I can use that doc to prove I can get my gun back...

Well, that should keep him from ever committing a crime again! I'm sure 3 years of probation will surely teach him a lesson that he won't soon forget!

Sorry, not trying to sh*t on your victory, it's just sad that our system allows people to break into someone's home, steal their guns, get caught with their guns and the penalty is 3 years of probation...

I am surprised he got that much.... These days they are letting everybody off with probation and no jail... UNLESS one of us LEGAL gun owners screws up and then we are hung out to dry!

There are 2 cases here, 1 is for the burglary, and the 2nd case which he got the 3 yrs probation is for the possession of the stolen gun in SF.

the burglary case is still in the works from what i was told by a detective 3 weeks ago.
Suspects PO will then drop by with the police to pick him up for the crimes.
Eventually he will serve time.

If I was up there I would have your back.

NorCalgunners, One of your Brothers is going to go to court to face down the punks who violated his home and pistols.

You know the defendants will have some people and family with them tryin to act hard and stare down our boy.

I encourage any of you guys up North to PM OP and set aside a free day to join Darklyte at the courtroom.

It would be great to have 5 to 10 guys with him for support and to stand by him.


He went through enough bullsht to now have to sit in court by himself getting mean mugged by some fools.

Thanks AUstate

So I went to SF today, took the wife out for lunch since its her bday.
Then after we stopped by the station which I got a property form and went down to the basement. The guy then hands me a slip because I didnt have another form he needed because he didnt tell me about that form when I called him 2 weeks ago.

The slip said I needed to go to the tenderloin station and speak to the inspector.
So I wait and finally the inspector tells me to contact the DA to find out if they still need the gun for evidence because the suspect didnt show for court * no surprise* so his probation was revoked.

Not to forget the suspect was caught in March of this year breaking in to another house in Antioch.

So im waiting for the DA to say if they still need to hold the gun or not.

So I didnt get to pick up my m&p

hopefully the DA will get back to me soon before this LEGR expires..

Wow, this really sucks I hope you are still able to protect your family. Now would be a great time to get a CCW if you wanted. I am sure the other houses he broke into he was only looking for skittles and tea so it wasn't his fault.

I hate the whole catch and release... No wonder he didnt show up... Its only a matter of time and they'll catch him AGAIN, hes a **** bag. Hope you get your M & P back op. Keep us updated.
