Default SHOTGUN MISSING/STOLEN FROM UPS

MY SHOTGUN LEFT THE UPS HUB IN SYLMAR FRIDAY MORNING FOR DELIVERY TO OAKTREE GUN CLUB AT 9 AM AND VANISHED INTO THIN AIR. UPS KEPT SAYING OUT FOR DELIVERY FOR 5 DAYS. IT IS A WINCHESTER SELECT GRADE 101 12 GAUGE WITH 20 1/2" BARRELS WHICH MAKE IT UNIQUE. SERIAL NUMBER IS

Yikes, Have they said anythig else or they sticking to that story for now? I would have the shipper start a claim.

I would call UPS and tell them you are filing a stolen firearms report with the police and the DOJ. I know you don't actually file a report with the DOJ, but they probably don't know that and it might light a fire under them to find the firearm and/or deal with the situation.

If this latest (2016) assault weapon (semi auto) ban passes... I will simply install hydraulically actuated rotating bolts, and jimmy slap triggers. They can't regulate what they don't understand.

Really? You think that one of the largest global logistics comapny really cares? They have a process and they'll follow it.

Not the fisrt gun ever lost/stolen.

Follow the process OP - call UPS and open a claim, you did insure the package right?

The shipper is filing claim. I am filing stolen gun report at laso and lapd.

Lets slow down for a minute.

First, did you buy the firearm online from someone? If so, it is not yours until it is delivered. So the fact that it never arrived is not your responsibility. It is the seller/shippers responsibility to make sure it gets to where it is going.

With that being said, why would you file a firearm report on a firearm that was never yours? I guess it is a socially responsible thing to do, but it really isn't your concern.

UPS probably doesn't care much that your package got lost. They certainly aren't going to shake in their boots that the firearm is missing. If they discover one of their employees is stealing, they turn them over to the cops. It isn't going to hurt them much.

Called and visited they have no record of it arriving. They checked vault and it is not there.
UPS shows it went out for delivery 10/26/12 at 8.54 am and UPS kept saying it was out for delivery for 5 days until i called the sylmar hub. The gun club asked ups guy and he said it was not on his truck after friday. Was never scanned out of truck.

Was it a one of a kind firearm? If not, I would pressure the seller to get you a replacement gun out right away so you can still finish DROS within 30 days.

If I were Oaktree, I would probably consider giving you a slight break since the gun went missing right off the UPS truck on its way to the club. However, DROS has been started so you would certainly be out $25 and I still have to do paperwork and maintain it even if you don't finish the transaction. That is the partial risk in starting DROS before the firearm arrives.

It was a one of a kind and the deros was $75. I am looking for other long gun to put in place so I am not out all the deros. Never had a gun disappear or not be what I expected. Going to gun show sunday to see whats out there. I need a kids 22 anyway like a cricket.

OP, Google "over-labeling theft by UPS". Look for it mentioned in gun forums. I had a UPS driver try to pocket over $1000 from a COD package I sent. The person I sent it to paid with cash not a money order. It took over a week of daily calls to UPS & threats of LE involvement to get my money. The driver was not fired or even disciplined. UPS is union.

Not so far called today and Oaktree said shipping receiving guy in tomorrow and will check stock and logs. After 8 days ups will pay. Issue check within 2 days and deliver within 7 . or so they say. On tue it will be listed as stolen . I hope it shows up somewhere.

I know a guy who had a handgun not show up for weeks and weeks in this situation and UPS ended up purchasing him a new handgun (some model of ruger .22), and thena few weeks later after he got his new one that UPS paid for, the original shows up.

Latest is ups investigated and opened claim. Waiting for final disposition and check. Have spent several hours and some travel to visit Oaktree and UPS in Sylmar . Then 2 trips to lapd to file theft report and pickup dr # . Gave them pics of gun and serial number.

It was a shipped in firearm from gunbroker.com sale. Fees for that at Oaktree is $75 including deros fee. They are cheapest in area except for some guy in Thousand Oaks.

UPS done with their investigation and they are sending check by friday for original invoice amount. No payment for fees. I'm out $75. LAPD is investigating now. Maybe some day it will turn up.

Better make sure the next time you get a DROS and not a deros. That deros sounded like a ripoff.

Hope they resolved the issue though.

If it was actually lost/misplaced, it will show up in the huge OS&D warehouse in Utah.

I had $900 in softball bats misplaced a few years ago. I was friendly with my work UPS driver at the time and he gave me a name and number of a lady in Utah who found my package 3 months after it was lost.

That actually depends on the F.O.B. terms of the sale. If its FOB (input sellers place of business), then the seller is relieved of liability if the goods are conforming at the time of shipment. If its FOB (input buyers place of business), then its the sellers responsibility until the goods arrive, subject to any force majure clause of the sale. If there is nothing to indicate otherwise in the contract, the default is FOB sellers place of business, and the seller is only responsible if the goods shipped were not conforming (i.e. the wrong shotgun)
