Her name is Nicole, she rambles on and on and all she really wants to be is a professional YouTube makeup artist. But she got fired from being an "executive assistant" soooooo... there's that.

Default Legal Advice

If it has not become apparent by now for those involved you are never going to see your money or your mosins. With that in mind the last course of action seems prosecution. IMHO I believe Jason broke some parts of 18 U.S.C § 922, dealing guns without a license, engaging as a business to make profit and so on. His wife is a co-conspirator since she received some funds via her PayPal account. At the very least he grossly abused his C&R license. A C&R license is to enhance one's own personal collection, not his bank account.

Anybody know the exact amount of mosins that he purchased? Wasn't it like 5 to 7 creates. That's 100 to 140 mosins!

If I was involved I would have raise all types of unholy hell with the BATFE. Since he has no intentions of delivery of his word to any of you wouldn't you at least like to see justice be served. Call, email and or snail mail all the local ATF field offices that you can. Time to put your tax dollars at work and get them Inspectors to do their job.

This ^^^^

He could also be guilty of wire fraud 18 U.S.C. § 1343 if any of his communication happened while out of state. There is probably a CA PC equivalent as well.

I'm going to put my oar in here even though this whole thing is none of my business....
I'm convinced that this guy has violated the terms of his FFL03 with these transactions. Like I said, it's none of my business but as an FFL03 myself, I do not want BATFE turning turning the evil-eye of Sauron upon us C&R's. We've stayed under the radar so far and that's the way I like it. Therefore, I encourage all parties involved to push for CRIMINAL action against this guy. If we in the gun community permit this type of behavior we reenforce the claim that people are acquiring firearms illegally by exploiting "loopholes" in the law.

I asked the same question back when the group buy was just getting started, hoping my question would get people to think about what they are getting involved in:

http://www.calguns.net/calgunforum/s...6&postcount=11

I wonder if Jason had to fill out a 4473 at J&G? If so, he had to lie when he answered the question 11a- "Are you the actual transferee/buyer of the firearm(s) listed on this form? Warning, you are not the actual buyer if you are aquiring the firearm(s) on behalf of another person."

I would say he was walking the razor's edge if he had delivered on the rifles. By pocketing the money he made a profit and that means he was clearly engaging in a "business", fraud or no.
Good question on the 4473. I've never used my 03 in person so I've never had that experience. Maybe one of the people who got burned should make a call to J&G and find out. I'm still baffled that J&G sold him so many knowing he was taking them across the border. If I were a business owner, I wouldn't want to touch that.

Well he did deliver at least 160 of those rifles. Unless he is sitting on some of them.

I present Exhibit A: Post #277 from the OG thread http://www.calguns.net/calgunforum/s...d.php?t=526624

Here are a few pics from the trip.

Overall it was fun as hell but super exhausting. We saw temperatures at around 20 degrees at night to almost 78ish on the way back during the day.

Here we are loading up the truck at J&G about halfway done loading...

The crates stacked up.

A lot of the Mosins (especially the Hex) looked freaking amazing. Great wood, awesome bores. I also saw a bunch of really unique markings that you won't normally see... way better than what you will see at Turners or Big 5 for sure... Also, everything was CAKED in cosmo.... have fun cleaning guys...

Last but not least, I got my CZ! Damn this gun shoots freaking awesome. Still can't believe you can walk into a gun store in Arizona, and walk out with a fully functional accurate handgun for under $300... blows my mind. The finish is a little bit worn but the barrel is perfect. Nailing groups out at 10M no problem.

I'm sure he more likely purchased that CZ82 off the backs of other calgunners.

Get off your duffs and drop the dime on this guy!

I've been following this soap opera for a while. Has anyone involved actually contacted the post office to inquire about postal fraud with the money orders or contacted the ATF regarding the possible straw purchase? Bi**h and gripe all you want but someone needs to get the ball rolling.

Class action suit. Toss in for a lawyer or two.

Hell, I'd make calls, but I got no dog in the fight. I'd just be told that an actual victim would have to file a complaint.

I could tell the guy was a scum bag by the way he held the group buy. The terms were basically, "I want to buy a bunch of moisins with other peoples money and pick the ones I want for myself and the rest of you will get the scraps". I would not be in the least bit surprised if he walked away with more than he paid for. I really hope the people who he stole money from have/will file charges.

Maybe they are doing something and keeping a low profile, maybe they're doing nothing.

Based on what I see here and on the abortive bolt carrier group buy...if I were a scammer in the weapons area, Calguns.net would be THE first place I'd advertize...

No independent review forum other than I-Trader, little to no banning of BS artists, and a relatively naive group of buyers who have no understanding of due diligence.

I'll take two!!!

I kid, I kid....I find myself reading this thread in a "misery loves company" kind of way. Waiting with baited breath for the group buys I'm involved with to finish.
Now that this is open to all for comments, Definitely court case....small claims? As a group? Is that doable?

Many of us are watching, being mindful that what you do we may have to with our own GBs.

What you should do with your own group buys is never pay to an individual up front. Anybody who does that is an idiot. Either people pay separately to a trusted company or somebody buys everything themselves and it's cash on delivery.

Hey thats not fair. I just ran a group buy for 169 of said product times 135 plus 15 times 140. Do the math. And only 1 person has so far reported a problem. I am diligently trying to figure it out, at an airport awaiting my flight for a vacation. This is bull****. To take so much money from so many individuals. Some of us have had to scrape to enjoy this hobby and group buy discounts give us that little bit of edge. I wasn't involved here but do not understand why this happened and why he is not either a) behind bars getting *** pounded or b) paying back in blood swest and tears every single dime.

If they sent you personally all that money up front, yeah, they were idiots. I'm glad it worked out for them and that you're a good guy and all that, but obviously it doesn't always work that way and you could have screwed them trivially. Keep in mind even after The Expertish was clearly screwing people he had all of his friends posting here about what a stand up guy he was and how everybody just needed to be patient.

Either way, this shouldnt be allowed. At all. He:
-abused privileges as an ffl holder
-stole money product and time
-and is bragging about it to boot.

Crush this guy
seriously. I enjoy group buys. I have participated in two and they went well. Where i paid upfront to a stranger.

I want to make some things clear and then bow out, because I never intended on derailing this thread.

1) fiferronald has been outstanding and upfront on all comms. No complaints there.
2) I/We/ most of use jumped on board on the GB (Rudius) knowing we were getting a screaming deal (half the price of advertised).
3) There's still hope, in that we have frames, jigs just not polymer grips yet. the hope lies in that, there are others looking to make grips for this pistol. So all is not lost. So I buy grips from a third party, I will still come out with a great priced project.

Ares may be a victim of bad timing (Newtown rush buying), they may come thru, maybe not, regardless all is not lost yet.

Finally, there have been GB that have gone off wonderfully, Aimsmall come to mind right away.

On your GB this guy has straight stole money, no product at all, not to mention as others have stated, abused his FFL. I understand the jaded feelings.

I am hoping for the best for this GB, hope monies appear, or at worst court action and wage attachment at minimum to recover monies.

People are watching for the outcome and rooting for you'all!!
There are peoples that would love to help in the recovery, that are not part of this GB, in the interest of fairness, brotherhood and Justice.

Well, we're no where near the point you'all are at yet.

Other than length of time, I have no complaints. I do understand that after sandyhook and the panic buying, schedules went out the window. I have recently started to wonder/worry about the perceived excuses about the grips.

If grips show up from Ares, well, the GB will have served its purpose, just not as quickly as was planned/hoped.
Patients is wearing thin for some. When/if people pull the trigger to go after Ares legally, then I'll be back to say it was a failure and didn't go well.

have been following this train wreck since day one (subbed to both threads so even have most the deleted posts in my email ..lol) and backed out of the radus GB1 due to this and other GB's, not wanting my $$$ tied up in their R&D and a year later proved to be true(still no grips so a useless product as of now) not saying that fiferronald has not done a great job on his end , but most of these GB have had issues for the most part .... glad to see this thread opened to the public so it does not get swept away and others can be warned of what may happen in GB's ...

Next Day: 04-02-2013 2:34 PM - Sitting on a beach in Florida, sipping Mai Tais and Long-island Ice Teas with a case of Samuel Adams for chasers, singing along with the radio as it churns out Otis Redding's "Sittin' on the Dock of the Bay" all with a Cheshire-Cat grin on his face.

Sitting in the morning sun,
I'll be sitting when the evening comes,
Watching the ships roll in,
And I watch 'em roll away again
Sitting on the dock of the bay,
Watching the tide roll away,
I'm just sitting on the dock of the bay
Wasting time

I left my home in 'Fornia,
Headed for St. Andrew Bay,
'Cause I had nothin' to live for
And look like nothing's gonna come my way
So I'm just Sitting on the dock of the bay
Watching the tide roll away,
I'm just sitting on the dock of the bay
Wasting time

Look like nothing's gonna change,
Everything still remains the same,
I can't do what ten people tell me to do,
So I guess I'll remain the same...

Sittin' here resting my bones
And this loneliness won't leave me alone
It's two thousand miles I roamed
Just to make this dock my home
Now, I'm just Sitting on the dock of the bay
Watching the tide roll away
I'm just sitting on the dock of the bay
Wasting time.

I have been following this thing from the beginning. I was even part of it and was going to send him M.O. at one point, but then backed out.

So now, if the above post is correct, he owes total of almost 5400 bucks! Cut your loses and sell his debt to a collection agency. There are agencies who instead of sending a bunch of letters and making phone calls, hire private investigators who show up in person and not only demand money, but they catalog assets.

You have all the proof you need here, his location can be easily determined. Seems like nobody is doing anything about this here, or are they?

Guns Indroduction

Hey Everyone,

Welcome to my blog. This is my opportunity to share one of my big passions with everyone who can read. It's no secret to my family and friends that I love guns. I don't see anything wrong with that. Oddly enough I use to. I use to have a fear and uneducated opinion on guns. Even after I purchased my first handgun at 21 I still wasn't totally sure about guns. I just knew I was drawn to them, I enjoyed shooting, and I knew they had a very practical application in life; whether that is for sport, hunting, competition, or home defense. It wasn't till after I decided I wanted to try my hand a law enforcement at the age of 26 that I really began to understand guns and "gun people".

That transformation has been even more dramatic since just last year after stumbling across a website that Google said could answer a question I had. That site turned out to be a God-send to me and has opened my eyes, ears, and mind to what is truly going on in the world around us. That site has been CalGuns. I'll post more on them in another blog.

The purpose of this blog is to force me to do something productive with my time and my guns. I know there are many new shooters out there, and even more who are curious about guns. I hope this blog will be useful to you. I plan on doing reviews, Q&A, demonstrations, how-to, tutorials, and education on guns and current laws. I'm not a professional or authority on any part of shooting, but I know enough to get people going in the right direction. I'm no full blown expert, but kind of an expert-ish on most any subject pertaining to guns. If I don't know the answer, I'll search it out, and make it a learning experience for us both. I hope you'll join me.

Shoot Safely,

Jason, aka TheExpertish.

It was a God-send alright. Hopefully there'll be hell to pay!
