Default A couple of questions from a concerned teenager

Hello everyone, I have a few questions id love to have answered.

1. What is the sentencing for a father that knowingly gives drugs to his kids of 14 years old?

2. If there is a "party" and it involves people under 21 drinking and doing drugs what is the best way to report it and what will the charges be?

3.Can you report a crime by email?

4. How come there's all these pictures of underage people doing drugs and drinking on Facebook? Can that be used against them? or does it have to be witnessed?

5. Is it legal to smoke weed in a car on the freeway even if you have a medical card or whatever? (some idiot cut me off and weaved through traffic dangerously while "hot boxing" I could tell because he rolled down his window in front of me > )

6. How would i report an incident like #5? If I'm driving is it legal to use my cell phone to report a crime?

Thank you for you time and answers, I appreciate it! and i appreciate all of your LEO'S hard work! Thanks for making California better!

The phone numbers for your local law enforcement should be in the government section of your local phone book. They usually list emergency and non emergency numbers. That same information is also often posted on your local law enforcements web site along with other contact information.

11361(b) H&S (giving, furnishing, etc. MJ to a minor 14 yrs. or older) is a felony with a maximum punishment of 5 years in state prison. Of course as a father the DA could go crazy and charge contributing to delinquency (272 PC), child endangerment (273a PC), abuse, etc.

Just so you know, you are exempt from using a hands free device while driving if you use a cell phone to report an emergency.

VC 23123....
(c) This section does not apply to a person using a wireless telephone for emergency purposes, including, but not limited to, an emergency call to a law enforcement agency, health care provider, fire department, or other emergency services agency or entity.

As others here stated and I will reaffirm, you can use your phone to dial 911 or otherwise notify authorities in the case of a legitmate emergency.

A wreckless or possible DUI driver (yes, even with marijuana) constitutes an emergency use of your cellphone.

It is 1000x better for police to stop the driver and ascertain his condition rather than get the call of an accident after the fact that he caused with impaired driving.

Should have known that. To me, it was just common sense reporting a 911 type incident outweighed the dont use your cell phone while driving thing.

The problem with this assumption is that "Common Sense" isn't anywhere in CA penal code, and more stupid things aren't unheard of...

That's an interesting signature block.... for a "concerned teenager" that is.

Actually, it is in CA Penal Code Section 4, which states:
Quote:
"The rule of the common law, that penal statutes are to be strictly construed, has no appplication to this Code. All its provisions are to be construed according to the fair import of their terms, with a view to effect its objects and to promote justice."
This indicates that strict enforcement of the CA Penal Code has NO PLACE in CA law. CA Penal law MUST be interpreted using common sense, with an aim at true justice, not the letter of the law.
