Default SB 249 Rumors and Status Conflicts

I'm sure many if not all of us have seen the rumors going around that SB 249 is 'dead', it's being reported by some 2A and shooting organizations.
At the same time others are saying it is not 'dead' and nothing has changed from this morning, Thursday is still the day the Appropriations Committee will hear the bill.

The last I have heard, from the NRA lobbyist and the CRPA lobbyist in Sacramento is that the bill is still alive and still on the schedule.

At this time it's safe to say that there is a lot of confusion about this and that it's understandable not to know what to believe.
I'm not going to tell you that 'X' is fact and everything else is hogwash, I know who I put my trust in but that is only my opinion and I can not call it 'fact'.

What I am going to say is this, dead or alive we can not stop fighting this bill because in politics things like this can be 'resurrected' on a moment's notice.
Until we have concrete information we should continue to press the fight forward and not give any slack.

If Thursday comes and SB 249 is not on the agenda, great.
We can take a deep breath, say we're one step closer to victory and get right back in to the game.
For 2012 this is not 'won' until September 1st and until then we should keep our powder dry and stay ready.

Take any rumors with a grain of salt, hope for the best but continue as if the worst were happening.
With luck tomorrow will lead to more information that can resolve these rumors.

It is the opinion of well placed NRA officials that this bill is not yet dead:

FACT: We are getting more and more law enforcement opposition to SB249. The pressure is mounting and it is doing so at the right time in the legislative process.

Please think about this: No matter what we hear out of the Capitol about SB249, if we are winning -- why would we let up? If we are not winning -- why would we let up?

PLEASE CONTINUE TO KEEP UP THE PRESSURE UNTIL WE CONFIRM THAT WE HAVE DEFEATED SB249.

Note: I was not planning to post anything regarding SB249 because so many people are already commenting on it. And off course, there are those who are complaining that they don't believe that the NRA has been involved in the fight against SB249 from the beginning --- because we don't post our strategy and tactics on the Internet for the anti-gunners to read. Oh well, complain if you want. But I won't roll around in the mud and argue with anyone. It doesn't accomplish anything.

If it does get pulled from the calendar and doesn't make it back on by Sept 1st, I understand that it's dead for this year (as Kestryll pointed out).

But does that just mean it's postponed indefinitly or is it defeated all together?
Can it just pop back up on the calendar in 2013?

I'm seeing news from 2 CA groups announcing that the Appropriations Committee has removed it from Thursday's calendar. If that's true it can't be brought up again until next year.

It would have to be a completely new bill - 2013 starts a new 2-year legislative session.

Not at all impossible.

Jan/Feb 2013 could be pretty interesting.

Maybe somebody on the Appropriations Comity recognized that if this bill were to become law, and get scrutinized against the Heller Vs D.C. decision, it might be the end of all our assault weapon laws. But I doubt it, to see beyond the scope of his own term the politician’s mentality must contradict it’s definition.

That's important to remember. Yee did not act on his own initiative or alone on this. Senators Darrel Steinberg, Kevin Deleon, Loni Hancock and Assemblymembers Anthony Portantino and Mike Feuer were the bill's coauthors. Of course, those names are behind some other legislation we've already faced.

My only two questions are:
1) WHY WOULD ANYONE TRUST THEM TO DO SO????

it means the committee does not want to hear or vote on it. It is essentially, dead in committee - it will not proceed from committee. But read what Yee says, he's going to look for regulatory, meaning DOJ avenues to explore this bill. CGN, get ready to save your pennies, I think we will need to start donating to pay for court fees...

Cal-FFL, Calguns Foundation opposition letters cited in official Committee analysis that may be the final straw in breaking SB 249

For Immediate Release: August 14, 2012

SAN CARLOS, CA, AND MADERA, CA – In spite of bill author Senator Leland Yee’s many assurances to the contrary, even the Assembly Appropriations Committee legislative analysis found that the SB 249 gun ban presents California taxpayers with significant cost impacts.

The analysis determined that, among other major costs, SB 249 would impose “[o]ne-time special fund (Dealer Record of Sale Fund- DROS) costs, likely in excess of $200,000 (the AG's office estimates about $400,000), for the AG to conform existing regulations regarding the definition of assault weapon to the definition of detachable magazine proposed by this bill.”

Implicit in the Committee’s analysis is that SB 249 is a material legislative change to the Penal Code, which would require new DOJ regulations. Senator Yee and his staff have spent considerable time representing SB 249 to be a “clarification of existing law.” We now have further evidence in the Legislative record supporting our argument that SB 249 would harm California gun owners by creating an entirely new standard for “detachable magazine” firearms.

Up-to-the-minute information acquired by Cal-FFL lobbyist Matt Gray of Capital Alliance and Cal-FFL president Brandon Combs suggests that, while SB 249 may not succeed in passing the Appropriations Committee due to the substantial costs issues, it is premature to consider the bill a non-threat to gun rights.

“SB 249 has been proven to be an outrageous attack on hundreds of millions of dollars of legal private property and law-abiding gun owners. We’re encouraged that the Appropriation Committee’s analysis has affirmed our view that California simply cannot afford Senator Yee’s misguided bill,” said Combs. “We urge all of our members and supporters to continue vigorously opposing SB 249 by calling the members of the Appropriations Committee and using the Take Action tools at our StopSB249.org campaign website.”

For the record, Paul, I don't believe for a minute that Yee and Keigwin aren't up to something shady. Before I saw this, I linked to your original post that this could re-surface anytime between now and August 31st under the "rules waiver" you mentioned:

Default Status of SB 249

When I called Senator Ted Gaines office this morning, Matt Cox answered the phone and said he would check on the status of SB 249 and get back to me. Below is the response from Megan Allred, Legislative Director for Senator Gaines.

I guess it's not over yet. So, the question now is, do we show up on the north steps of the Capitol tomorrow at 9:00 am, or not?

Good morning,

Despite the rumors, we have not been informed that SB 249 has been pulled from any agenda. Even if the author does not move it right away, we never consider anything officially dead, nor us “out of the woods” until August 31st, which is the absolute last day that bills have to be passed for this legislative session. Even if the author says he will not move it, he still could find the votes and push it through last minute. So I would hold any celebration until August 31st. At that point, if the bills still fails to move, we will be celebrating right there along with you!

I wonder if we came close to crashing the email server during this. Maybe the phones faxes emails were starting to get annoying and they stopped. We will know soon enough whether this bill is dead for the session soon enough. And of course the NRA is here this us the front line. And when Yee and his complain about the NRA then you know they did the job.

I read into this we must continue the hard push with email, snail mail, phone, and fax.

Keep the pressure on. I just got more than half dozen friends emailing to the appropriation committee.

Let's not slack off till SB249 won't show up as a zombie to haunt us.
