Default Legal ? Neck Knifes

I hope this is the right forem I saw legal advice.
I was wondering if a fixed blade neck knife were legel to wear in CA? and other states for that matter. I live in CA.

Thanks to all for helping the new guy I have already learned a lot !

21310. Except as provided in Chapter 1 (commencing with Section
17700) of Division 2 of Title 2, any person in this state who carries
concealed upon the person any dirk or dagger is punishable by
imprisonment in a county jail not exceeding one year or in the state
prison.

As the law is written, doesn't matter what it's called. If it's any fixed blade knife over 2 inches that is concealed, it's considered an illegal dirk/dagger

The neck knive is a fixed one sided blade about 3 to 4 inches of blade (depends on were its measured from) Its in a sheath on a small leather rope.

a fxed blade neck knife is considered a "dirk or dagger" and it is illegal to carry it concealed.


16470. As used in this part, "dirk" or "dagger" means a knife or
other instrument with or without a handguard that is capable of ready
use as a stabbing weapon that may inflict great bodily injury or
death. A nonlocking folding knife, a folding knife that is not
prohibited by Section 21510, or a pocketknife is capable of ready use
as a stabbing weapon that may inflict great bodily injury or death
only if the blade of the knife is exposed and locked into position.

If the neck knife is worn outside your shirt at all times it is not concealed and therefore legal. If it ever ends up out of site, covered by your shirt, jacket etc. it is a crime.

I don't recall there being a minimum length for it to be considered a dirk or dagger. The 2" rule is there for switchblades.

doesn't matter if it is one-sided or two-sided. A concealed .mil Ka-Bar would be an illegally concealed dirk or dagger.

The knife is legal.
The intended mode of carry is a NO GO.
Fixed blade knives may not be concealed.

Nice Ok thats what I needed. No more neck knive for me. I must find one less then two inches.... Bummer I liked that knive It was actually very functionable. I really thought it would help protect me and my family in a bad situation.

That sucks Laws make it so we can not defend ourselfs.. BAD GUYS DO NOT FOLLOW THE LAWS.

It is a crime to carry a concealed fixed blade knife even of the blade is less than 2" long.

i know its not a fixed blade, and i know it is kinda big but this is the one i carry. It is the Cold Steel AK47. I am sorry to say but it is an expensive knife HOWEVER it is my second Cold Steel knife(only because my wife stold my first). The first one i have had for going on 5 years and i have not had any problems with it other then having to sharpen it. it locks very very well and the thing i like most about it is when you pull it outfast(like you needed it) there is a kinda hoook that catches your pocket and opens the knife.

So its even worse NO neck knife... Big 5 sells little crummy ones under 2inches but oh well no wasted money will be spent at big 5.

The knife I have is nice (was nice) It has a great handle full tang and a tanto blade, very slim never noticeable with a strong blastic type sheath.

I am so bummed !!

Yes I carry a pocket knife with quick thumb opener. But I still think I (know from practice)My neck knife was fast accessible and the bad guy wouldn't even know I had it until he felt the blade cutting that mother bleeb.

Nice I like it. Mines very close to that and love it. But from what I learned here I will not be wearing it anymore.
I will still do some more research.

note that in CA, a concealed pencil could be considered a dirk/dagger.

You can carry a fixed blade as big as you want in CA, as long as its not concealed or double edged. Local laws might be different depending where you live (make sure you know them, call your sheriff).

Just wear it on the outside of your clothing, visible.

Just to clarify ANY knife in the ready position is considered a fixed blade. If you open a folding knife then put it into your pocket it is now a concealed fixed blade, because it is in the ready position.

Ya I know about open carry knife. I just might get over my stigma about wearing one. Since I can't hide a good knife ,then I'll carry a great one !

Legally there is no difference between a double edged and single edged knife. Assuming they are both fixed blades (or an open folding knife, as others have pointed out):
Open=legal
Concealed=illegal

Not withstanding any local ordinances, which you should also educate yourself on. Of course I am not an attorney so this is not legal advice and should not be taken as such.

Just get a folding knife and be done with it. Fixed blades are too much hassle in this state. Folders, on the other hand, can be carried concealed, openly, or however else amuses you. And barring a local ordenance, there is no size limit.

Yup. Folders are pretty awesome these days and there's a huge variety to pick from. You'll end up using a folder a lot more than a neck knife anyways.

Not necessarily. I frequently OC a Cold Steel Safe Keeper II and have never been hassled for it either by police or other regular citizens. The only time it would really be a hassle is going onto a school campus, which I never do.
