There is no pre or post ban distinction anymore, it was a federal issue. Just refer to the uppers by features.
But if you are going to fix the magazine on the lower, then go with a "preban" upper with a flash suppressor and any other evil features you want. If you want to run with a detachable magazine, then you need to have a featureless upper with no "evil traits" and no pistol grip on the lower.

Pre-ban uppers should only be used in fixed mag builds. DO NOT use a pre-ban upper in a fixed mag build.
ONLY USE post-ban uppers to build detachable magazine rifles. |

Fed postban uppers had no bayonet lugs, no flash hiders, nor were they threaded to accept flash hiders (which is why muzzle brakes were permanently affixed even to 16" and longer bbls on postban configurations). CA law does not care about threaded bbls or permanent affixation of muzzle devices on rifles (other than to get up to 16" long), and does not care about bayonet lugs. So as long as the upper has a muzzle brake and the bbl is 16", you're good to go if you use a detachable mag.
