Default C&R pistols and "The Roster"

OK...school me. Or find a thread I can read, 'cause I sure can't.

Are C&R pistols exempt from the roster?

Yes they are. And they don't have to be over 50 year old, just on the C&R list.

Calif. PC 12132{g} {C&R exemption} They are also exempt from the 10 day wait if
you have an 03 FFL and a COE. If you get both of those .....buy a bigger safe.

California FFLs may not transfer handguns which are not on the Roster unless the individual or guns or kind of transaction are listed as exceptions.

Current exceptions include:

1. peace officers with official identification;
2. gifts from out-of-state immediate family members (who are defined as parents, grandparents, children and grandchildren only; brothers and other familial relationships are not included);
3. curios and relics;
4. Olympic pistols listed in Penal Code 12132(h)(2);
5. private party transactions (PPT)Penal Code 12132(a) PPT is described in Penal Code 12082;
6. Single shot pistols that meet certain dimensional and other requirements in Penal Code 12133 (a) and (b) and described further below.
7. Single-action revolvers (basically any standard size single-action: Colt, Ruger, Uberti, etc) that fit the following criteria are exempt from the Roster (Penal Code 12133) described further below.

Sweet...thanks for the great info, guys.

I did a PPT for a CZ52 pistol (vzor 52, but why split hairs) which is C&R, but thought the PPT part was the exclusion. Yeah, my bank account, safe, C&R license and COE are all gonna get a workout. I've been looking at getting a P-38, and there's a good online source.

It'll also exempt you from the 1 handgun a month rule. Theoretically, it'll also allow you to get ammo online when 962 kicks in.

I'm still banking on that getting ripped apart by The Right People.

bypasses the 10 day wait on C&R gun ONLY and only when used with a C&R license.

Those two in combination, as mentioned above, bypass the one handgun a month thing for both C&R and modern handguns. It may take some convincing at the gun store that that is the case, but it is.

I saw a post earlier (can't find it now) where someone said even if a handgun is on the Federal Curio & Relic list it still had to be over 50 yrs old (e.g., CZ 82) in CA to be a Curio & Relic. That didn't sound right to me but I didn't question it at the time. I will now: Do listed C&R handguns have to be >50 y.o. to be exempt from the roster in CA?

More or less. I don't know what the COE is useful for without the 03 unless you work at a gun store. I was under the impression that gun store employees were required to have them so that their finger prints were on file.

No, they don't need to be over 50 years old. To be exempt from the Roster, handguns just need to be considered C&R by the Feds. That means they either have to be on the Federal C&R list or they have to be at least 50 years old.

California does not have its own definition of "C&R". California only uses the Federal definition. Every single firearm that the Feds say is C&R is also C&R in California. California imposes certain transfer requirements on C&R long guns that are not yet 50 years old and on C&R handguns. But those firearms are still C&R in California.
