Thumbs up Thank you Jason Davis + CGF

Ever since my arrest from last April, it's been a nightmare. From going with the wrong law firm, uneducated/uninformed attorney disregarding all evidence and previous court cases and suggesting me to plead guilty to something that I did NOT do, giving my DNA sample, going to life lesson classes, to surrendering my gun rights...Until about a month ago, I was really fed up, fired my attorney and contacted CGF, Kevin (Oaklander) who referred me to attorney Jason Davis.

I finally got a chance to meet up with him this Wednesday and all it took was 1 phone call from Jason to the police department, that same night the detective called back and told me I was all good to go and I could pick up my firearm that they confiscated and refused to return just a month ago. All I can say is wow!!! Jason did what my attorney couldn't do for a year in 1 phone call.

Guys, if you ever run into ANY trouble at all, contact CGF & Jason immediately. Don't even bother trying to save a few bucks and going with amateurs, because in the end it'll come back and bite you in the ***. Which I learned the hard way.

I'd like to thank you CGF & Kevin & Jason for helping an innocent, responsible and law-abiding citizen retain his rights! Now it's my turn to payback CGF and help out the next victim.

This is a lesson that everybody should learn. Lawyers are specialists and especially when dealing with firearms. Make sure you get the right guy for the job.

Would you be willing to post the name/information of the attorney we should *not* be going with?

If you're worried about anything, you could PM me and keep it out of the public.

I put CGF info in my range bag along with my cell phone and my personal phone book at my house. Because you never now what might happen.

Jeffu,
Congrats on getting your gun back.
Cheers,

There is no substitute for an Attorney that is well informed and experienced in your particular type of case.

Jason Davis seems to be just that Attorney when it comes to firearms cases in California.

Good job Mr. Davis.

In this case we wish that this person would have called us first so the first bit of nastiness didn't even happen. As long as you are innocent of the gun charge and whatever caused you to be in contact with law enforcement is minor, we can almost always help.

We have quite a few more stories just like this about ready for public consumption.

It is sad that most attorneys that a working man can get to return his phone calls are just plea deal makers. Even if you are innocent, most say just plead to this "minor charge". There are NO minor charges anymore. I am in the commercial air conditioning business and if you even have an arrest with no conviction you will be denied a badge or access to many high security sites and some seemingly low security sites. ANY plea will fallow you FOREVER! expungement will not help, they will find out about the arrest. I have seen this many times.

Thank you calguns and the lawfirms that are fighting these injustices.

This is so true... I have done work in several secure locations/facilities... One general contractor was not able to use a project superintendent that had a 20-year-old felony (that today would be a slap on the wrist/rehab/dismissal today). The conviction denied him access to the facility...

Correct.

Things we've been willing to tolerate (not an exhaustive list):
Accidental ND.
Right turn from center turn lane.
No front license plate.
Cracked windshield.
LEO chased bad guy into gunowners yard.
Welfare checks.
Unstable roommate.

This also serves as a nice list of things to keep an eye on to not have interactions with LEOs.

Adding to what Gene says above - and enough time has elapsed such that the individual will not be identified from this - is if CGF rejects a non-open carry case (i.e, OLL vs AW, magazine, etc.) it often is due to "color".

We had an incident back last year where an individual was rolling with an OLL that was OK - but there were other unfortunate circumstances regarding other items in the vehicle and also with one of the passengers. The color was less of intent than incompetence combined with "bad friend selection".

The matter happily seemed to go away, certainly with the OLL (and CGF would offer assistance on the legit OLL rifle matters) -- but the defendant excoriated us to his friends, asserting 100% legality, while not mentioning the other troublesome "color"/conduct/background. Friends took him at face value and sent nastygrams to us; they tried to make CGF look like we backed off for whatever other reason (i.e., timidity or incompetence) other than orig. defendant's own issues, and spread falsehoods about CGF.

So please keep in mind that there can be "background" in such cases, and "friends of the defendant" may not have complete info even though they're bashing CGF. And we really don't want to hurt somebody by revealing case details (even though they're often public record).

No problem, I was arrested for loaded firearm in public even though it wasn't, and it was locked in a box and locked again in the trunk of my car.

And in this case I think I can independently confirm Jeff's statement. The saddest part is that Jeff gave his first lawyer a copy of People v. Clark with which Jeff had perfectly complied....

Was this a side saddle or butstock mag carrier issue? Or loaded mags in the same case as a loaded handgun?

Was this the one where they busted the guy for a loaded weapon because he was transporting it with a snap cap in the chamber?

Nah. This firearm was completely unloaded and in a couple of locked containers... Not even a question that it was legal.

Thank you JeffU for contacting CGF, I am glad this turned out better than where it was heading.

Don't take chances folks, the CGF is here for all of us if LEO get involved.

What made them think it was loaded? Did you have loaded mags? I stopped transporting loaded mags, even though it's legal, just to avoid crap like this. I'm glad you got your name cleared. Kudos to CGF & lawyers.

Plus, makes me wonder what gave the cops a reason to search? I know details are intrusive so only if one feels comfortable. It would help us however.

The "problem" was 1 round in the Sunset Insert. Not considered "loaded" because the round is not in a position to fire, so no crime was committed under the Clark standard.

These threads contain some background information on the case:

I am glad things worked out! Jason is awesome!

One of the reasons that we ask people to contact CGF is because we know the right attorneys to put on a given case.

Jeffu congratulations on the case turning out well.

It goes to show yet again that CGF does a lot of great work. Also has a lot of great lawyers willing to do the right thing when things go wrong for someone that shouldn't be going through the system.

While right now I cannot afford to donate any cash to CGF I will donate my time to help them out as much as I can. Hopefully soon I will be working again and can afford to help them out with money.
