Default After McDonald wins. Timeline for Sykes & Pena?

How quickly will things progress with Sykes and Pena after McDonald?

OK, I'm no lawyer, but wouldn't it possibly depend on exactly what is said in the opinion on McDonald?

As I understand it, even an opinion generally favorable to civil rights could be shaded any number of ways which could substantially change the approach to other cases such as Sykes.

And while I think the odds are good, remember that McDonald has not yet been heard, let alone decided.

Perhaps what comes out of Palmer in the lower court may flavor things a bit. That is coming up.

Both cases will likely be moved quickly back to MSJ status which means the oral arguments that didn't happen would happen in 30 to 60 days after the McDonald decision.
