This looks like it would be a good shooter if it could be sold in CA.

I know that it does not fall under the Roberti-Roos or SB23 prohibitions because both of these provisions specifically apply ONLY to semi-auto rifles.

Anyone have legal authority to the contrary?

If they are legal, anyone know of a FFL holder who will transfer one?

Isn't the problem here mostly centered around the fact that this AR uses the same lower receiver as a standard semi auto AR?

If so.. this is a NO GO..

I don't know about that, Turby. The PAR-1 pump AK is perfectly legal for sale and possession in CA. Thousands have been legally sold over the past couple of years.

As far as I can tell, it has the same receiver as the banned semi-auto AK rifle, however, it is sold in a pump action configuration with the full approval of the CA DOJ.

This has been discussed (not necessarily fully resolved!) here before.

DPMS Panther Pump AR is NOT legal in CA. All DPMS ARs are banned via Kasler decision and is specifically listed in DOJ Roster of AR and AK Weapons.

But _some_ Pump AKs are California legal since they got DOJ approval (just like FAB10, Vulcan and GB Sales fixed-mag ARs). Something reasonably permanent (i.e., takes time+ skill/tools to remove) was done to these AKs' receivers/trunnions to make 'em different enough from a regular AK receiver. That might not be substantial (like the Vulcan AR's glue + roll pin) but in the DOJ's eyes, it's "just enough".
I'd also bet that some pump AKs are NOT California legal and that anyone in CA wanting one should only get the CA approved version.
Also, AK doesn't have a separate upper & lower receiver like AR so the serialized receiver can be assigned a semiauto or pump status.

However, an AR action is different. AR lowers capable of accepting external hicap mags are separate from the operational system, since semiauto-vs-pump is determined by the (unserialized) upper and not anything on the lower.

If you could build a custom AR upper + lower so that the lower would only function with a specialty pump upper, then it's no longer an AR and could be approved by DOJ.
