I placed calls Monday and Wednesday, and finally got a voicemail today letting me know that she is working on the background check.

They're definitely behind schedule... Not sure if my calls got it moving or not, but I hope they get finished up soon as I'm missing some deals and the end of the year is getting closer by the day.

Also really could have used the discount with all the stuff I've bought recently.

Tomorrow is 3 months out from the day I mailed my app. I called and left a message twice last week and sent two emails.

Next step, I am calling and emailing everyday until I hear something.

I think maybe who ever is reviewing my app must have just been transferred over from the IRS.

I am right there with you! I called and they said I am still undergoing the FBI background check.

My FFL packet is at my office. If I remember I can give you a name & # to call at the ATF. They are surprisingly pleasant to deal with over the phone.

Well, it doesn't appear that the previous prodding got anything moving, as I still haven't had any further progress. I called and sent emails again the other day and have yet to receive a response from either.

I'm also over 90 days now... and impatiently waiting.

Cool Excecuted the FFL-03 and the COE process

Facinated by the idea of getting my hands on some old firearms I dove into the paperwork and laws for the FFL-03 C&R and the COE.

While taking some CCW and CHP's I happened to be taught by an instructor that was a licensed finger Printer and a licensed Lifecan operator.

He was more than happy to help me with the forms. He simply sent me the links to the forms, all PDF, and filled them out in font and size they asked for.

Taking all the FP's and sending in the Lifescan, fees and forms, I knew it was just gonig to be a while so I just played the patience game. 8-12 weeks.

I started the paperwork while taking the Utah CCW class, March 1st 2013. I interestingly got a call from Yvette on may 5th, which I think is the same person here in the threads for years, asked for a birthday year verification.

I gave the answer, and she said thank you and I asked if there was anything else she needed, and she replied no. "You should see your FFL-03 in about 3 weeks".

In the mean time, I got my COE in the mail on may 5th and soon I will have both documents.

What I noted in this thread that does not seem to get mentioned are all the conditions are to be conmpleted. Here is the Penal Code extraction from the COE Cover letter.


For code:

26700. As used in this division, and in any other provision listed
in Section 16580, "dealer," "licensee," or "person licensed pursuant
to Sections 26700 to 26915, inclusive" means a person who satisfies
all of the following requirements:

Check!! (a) Has a valid federal firearms license.

What is this?? (b) Has any regulatory or business license, or licenses, required
by local government.

I can get one of These (c) Has a valid seller's permit issued by the State Board of Equalization.

Check! (d) Has a certificate of eligibility issued by the Department of
Justice pursuant to Section 26710.

(e) Has a license issued in the format prescribed by subdivision
(c) of Section 26705.

(f) Is among those recorded in the centralized list specified in
Section 26715.

So an FFL-03 is not a Dealer, but a collector An on occasion we would sell an C&R.

I can see a log book or transaction log is somthing we need to do, but do we need to have a license from the City?

I can also see the sellers permit, they are free or easy to get, but it implies to also have a business name.


Here is Penal Code section:

26705. (a) The duly constituted licensing authority of a city,
county, or a city and county shall accept applications for, and may
grant licenses permitting, licensees to sell firearms at retail
within the city, county, or city and county. The duly constituted
licensing authority shall inform applicants who are denied licenses
of the reasons for the denial in writing.

>> Am I reading thisi right, the FFL-03 and COE allows me to buy C&R's becasue I have a license or does this men I need yet another license?

(b) No license shall be granted to any applicant who fails to
provide a copy of the applicant's valid federal firearms license,
valid seller's permit issued by the State Board of Equalization, and
the certificate of eligibility described in Section 26710.

>> So this implies I am an applicant to to sell C&R is how I read this. So I need to at least get a sellers permit and send them a copy of my FFL-03 License.


(c) A license granted by the duly constituted licensing authority
of any city, county, or city and county, shall be valid for not more
than one year from the date of issuance and shall be in one of the
following forms:
(1) In the form prescribed by the Attorney General.
(2) A regulatory or business license that states on its face
"Valid for Retail Sales of Firearms" and is endorsed by the signature
of the issuing authority.

Again, this implies a City license now needs to be granted in the second part, but the 1st part is the FFL-03 and the COE right? And the FFL-03 / COE are the licenses I have to be able to buy and sell C&R's?


(3) A letter from the duly constituted licensing authority having
primary jurisdiction for the applicant's intended business location
stating that the jurisdiction does not require any form of regulatory
or business license or does not otherwise restrict or regulate the
sale of firearms.

>> So Does this mean the DOJ BATF are the juristdiction and I have no restrictions and am good to go to buy C&R's?

(d) Local licensing authorities may assess fees to recover their
full costs of processing applications for licenses.

Yup, there is a fee.


This section appears to apply more to the FFL-01 liccense and not a collector, and I would not be selling or trading guns unless they were C&R and I think Private Sales to date, as I would be collecting them. How much does this apply to us FFL-03/COE License holders? Am I just reading too much into this?

Do I need to regsiter a Business name. I have one picked out if needed.

I do say the 4 benefits I see with the FFL-03 and the COE are:

1. C&R Long Guns can be shipped directly to your home address. Seen this in a lot of places. I like the poster of the Dealers that will regsiter your FFL-03 and do Business with you. I will send out letters once I get my license

2. The Ca 1 in 30 handgun purchase Exepmtion.

3. the 10 day wait period does not apply to to FFL-03 C&R Firearms. Als othough a 50+ year old handgun still needs t obe registered within 10 days by form.

4. Exempt from the Hand Gun safty Certificate although I do hold one already.


Anyone have insight they can share for a newbie?

WOOO HOOOOO...Received my FFL03 yesterday. Processing was around 5 months. Submitted my paper work end of December.

I guess now the best thing to do is apply for the COE.

*One quick question, I know that with the FFL03, you can have long guns direct ship to your door but what about C&R handuns? I've only read that in-state handguns need to go through a FFL, nothing about out of state.

$47..ha ha. I f'ed up on my taxes last year, owed 7k, still got mine!
But yeah, it's coming, but not sure calls are going to make them speed these things up.

I sent in my application and check on 4/16, check was cashed on 4/22. Called ATF on 6/13 was given a file number and told it was going to be in the mail in a few weeks.

FINALLY! Sorry, I had to get that out. Mailed off form 2-23-13, charged 2-26-13, received license in the mail today, 6-20-13. End of last month I had sent an email requesting any update info, which was never answered. Looking at the envelope, I honestly told the wife "this is a rejection letter for whatever reason." Thankfully, I was wrong. So they are pushing them out, just slowly. Good luck to the others still waiting!

just send it Attn to the CoP at the Headquarters address. http://www.sandiego.gov/police/contact/index.shtml .

if you don't live in SD but in a surrounding community, you must know where the Police station is at in your town, just send it to that address. it isn't rocket science, just make a good effort to determine who your CLEO is, send it to the most obvious address, and be done with it.

I doubt anybody who sent it to the Sheriff while he lived in a city with a Police Chief got his 03FFL denied.

Hi guys, I'm about to fill out the C&R application for the first time, and just wanted to clarify something: I've read in various threads that it helps to have an active hunting license. Have you guys found this to be the case or is this nonsense? I'm planning on -eventually- getting into hunting as well but I was more interested in C&R collecting for now, so it wouldn't hurt me to get a hunting license I just didn't want to potentially double my paperwork and time investment if it wasn't necessary yet.

While it might make it favorable, it is not necessary to get a hunting license to get your FFL03. The general consensus is that if you are a non-prohibited person and are able to purchase guns, you are already qualified and may apply apply to get your FFL03.

Question. It seems to be taking about 3 mos to get. At this point, I'll only be able to use it for 2mos. Worth it, or not?

I'm waiting too. Sent in the paper work on 7/19 and card was charged on 7/25. So I guess I'll try not to think about this again until Halloween.

Day 178

I've left a message for Yvette every day for the past two weeks. Finally spoke with her this morning. My application was approved back in May. Seems it never made it out to be processed.

She promised me that she would make sure my application gets processed and mailed out ASAP.

So another week or so before I finally receive it. I also applied for my COE last month and waiting for it.

All I can say is that I am happy things are moving again and I wish that I didn't sit on my butt and wait to handle this sooner.
