Default Obama Care: Senate amendment 3276, Sec. 2716, part c.

According to reports, that amendment says the government cannot collect “any information relating to the lawful ownership or possession of a firearm or ammunition.”

Yes - According to what I have heard, Harry Reid had that section put in as one of his few favors to the firearm community.

The "healthcare system" of the government can't collect any information.

Nice try. They will do what they want anyway. We still have to fight.

I believe FOPA forbids ATF from collecting that information. They do it anyway (the 4473 system itself, their Trace system, mandatory 4473 dump when FFLs quit).

Supposedly the reasoning is "our administrative rule precedes FOPA". Rather interesting, since the rule every 1L knows is "more recent law always controls".

If Congress isn't willing to slap down open rebellion by Federal agencies not much can be done.

On my son's two previous visit's to his pediatrician I've been asked to leave the room. As predicted, he was asked about guns in the house.
We've talked about this before and he knows the drill. His question to his doctor when asked the gun question was/is:
"what does this have to do with my check up or my health?"
On his last visit in October she didn't ask again.

its odd... i received a call from my health care provider. Blue Cross a week ago and it was an over the phone thing. asking me questions like, have you ever been sad? have you ever been depressed? do you have a support system etc all rated on a scale of 1-7, 1 being low 7 being high.

That request is ridiculous on it's face. What legitimate reason could there be to ask a parent to leave the side of their minor child during a medical appointment?

The nanny state train is off rails.

Read the actual text of the law, if you can find it. It just says that health/wellness activities carried out under the particular statute cannot collect information about gun ownership, and that the Secretary (I believe this means the Secretary of HHS) is not empowered by the particular statute to gather any such information, but it is NOT a blanket prohibition on the federal government collecting such information.
