Default NRA/CRPA Seeking AW Plaintiffs!!

I just received this from the CRPA Executive Director Rick Travis:

NRA and CRPA attorneys are ready to file an important lawsuit on behalf of all gun owners and Second Amendment supporters here in California. You can be a part of it by serving as a plaintiff.

If you or someone you know is a California resident (particularly from Fresno County) who owns one or more firearms now classified as an “assault weapon,” intends to register such firearm(s) with the California Department of Justice by December 31, 2017, and is willing to serve as a plaintiff in a lawsuit, please send an email to potentialplaintiffs@michellawyers.com or call (562) 216-4444.

Even if you aren’t sure about what it means to be a plaintiff or have other questions about the upcoming lawsuit, don’t hesitate in reaching out. Act now and be a part of our fight against California’s unconstitutional and ineffective gun control laws!

Thank you

Rick Travis

I think they are looking for those that will have 'standing' as in meat in the game.

I will call in the morning. I don't intend on registering, but I will ask if I can help any other way.

By finding someone else who intends to register and is interested in being a plaintiff; particularly in the Fresno region.

Why Fresno? And how far north would you consider that region to extend?

I'm going to take a stab in the dark here I'd say it's either because they want the case heard in a specific circuit or court or because they want it geographically far enough from another case that they won't be summarily combined.

Combined cases become a case, kind of like the difference between a bullet and a shotgun pattern.

I don't have anything considered an assault rifle, just old C&Rs, but I will pass this along to the guys at work.

Good luck.

I also think it adds more weight when there are multiple plaintiffs.

Mostly for bump, wish I were in Fresno...

answer...

Judges in their decisions (opinions) will sometimes cite the applied circumstances of plaintiffs (e.g. "disabled plaintiff bob has poor use of his right arm and hand, making the roster of certified pistols prevent him from buying the custom disabled-friendly blaster that would allow him to exercise his core right to self defense").

More plaintiffs, with preferably varying & extreme personal circumstances that make the law particularly egregious to their circumstances, help give a judge that might rule in our favor fodder to draw from when writing their opinion (and making their decision in the first place).

For example, Heller (of Heller vs DC) as a plaintiff was a LEO in DC. He was allowed (obviously) to carry a pistol on duty in DC, but then wasn't allowed to possess one in his own home. Circumstances like that help judges, at least on the edges, say "that don't make no sense." Multiple plaintiffs increases the odds of such thought process.

There are other reasons too, like one plaintiff being found not to have standing for whatever reason, then there are still other plaintiffs so the lawsuit isn't dismissed entirely. Or what if one of the plaintiffs personally chooses to withdraw for whatever reason (eg job requires them to move to east coast). And so forth.
