Default The process of geting an Type 03 FFL and COE

Hello everyone,
Like most of you, I have a great interest in C&R firearms and I am considering applying for a Type 03 FFL. In reading other threads, I noticed that some Calgunners talk about having a COE as well. Can anyone tell me the process for obtaining an 03 FFL and COE, such as do I apply for them both at the same time, do I apply for one before the other, etc? Also, what advantages does having an 03 FFL give those who have it, with regard to purchasing to purchasing and selling firearms? I know the laws are changing on January 1, 2014, but do any of these changes effect 03 FFL holders and how firearms and purchased and sold using an 03 FFL? If anyone can help me out with answers to my questions regarding having an 03 FFL, I would really appreciate it.

Was thinking about getting my COE also.

Its the same process for getting a free state CHL I am pretty sure. Fill out form, get livescanned and send check.

And one is state, the COE, the other is Federal, the FFL.

You need a 03FFL application. You don't need to submit fingerprints for the 03, or at least you didn't need to when I got mine. Its 10 bucks a year for three years.

Fill out form then wait. My renewal was held up because I didn't check a box. Make sure the form is filled out exactly as described in the instructions.

The C&R takes longer so do that one first. Apply right now and you should be able to get a few in before the last minute panic and increased prices that are coming. You need the COE for after the first of the year to be able to keep using your C&R. If you are married you should probably think about paying UPS $40 to become a "My UPS" member so that you can control when and how packages are delivered. FedEx will let you do it for free. If you don't have room in your safe right now, go buy another one, you are going to need it.

OK, great. Thanks for the info. I am kind of new to this so, I am wondering why prices are going to go up after the first of the year? What does UPS have to do with me being married and having packages delivered? Also, on the COE application, it asks for my ATI number, but I do not know what that is, does anyone know what that means and what I would put for that?

ATI is the applicant tracking number. The livescan operator provides that. Cheers.

I'm also interested in starting the paperwork and wanted to know how will online orders will be impacted with the long gun registration beginning in 2014. Will you still be able to order for example mosins and have them shipped to your house? Sorry I just started looking into it and would appreciate any info.

According to the COE form, you'll get the ATI number from the Livescan operator.

To the OP 'position and SSN' means, I think, what position you hold in relation to the license.


The form is set up for corporations and patnerships as well, as you are neither, your 'position' is just you. The form specifies different kinds of 'positions' It looks like you would be defined as an 'individual owner'

Scroll down on the form and you will find defintions and instructions for every line on the form.

Or call the ATF license office in West Virginia. They are usually pretty helpful.

If your record is clean and the form has no errors, the current wait is around 3 weeks from sending the application to getting the the license in the mail.

I think that will still work if you have a COE as well.

To the OP, that would be one reason to get a COE. I believe you are exempt from the 10 day wait on C&R handguns with a COE/FFL03 as well.

That's lightening fast. I got mine within 90 days and I thought that was an incredible turnaround...

There was some stupid **** going on a few years ago with C&R licenses in the LA area, ATF wanting to do home inspections, not understanding their own process and other rubbish.

There were threads about it in this forum. 3 weeks.. They must have fixed the problem

do I need to have an FFL 03 when I submit my COE? Or, can I apply to both at the same time? I submitted my FFL 03 stuff yesterday, should I send in the COE one soon or wait to hear back about the FFL 03 first?

FFL 03 takes about 3~4 month to process and good for 3 years , COE takes 3~4 weeks and good for 1 year. Wait till you get your 03 first then apply for COE.

Is the only benefit the ability to get C&R pistols without the 10-day wait? Do we still need to DROs them?

You always have to DROS pistols (and C&R long guns out of a dealer's inventory)...the 03+COE exempts you from the 10-day wait.

It also exempts you from the 1-in-30 restriction for any pistol, not just C&R. This comes in really handy. No need to worry about your 1-in-30 when two pistols you've been waiting for come in at the same time.

And with long gun registration coming in 2014, having the COE is more useful than ever.

I have a C&R and didnt know there is a requirement to have a COE too, beginning 2014. That true? Where is the info about it?

By the way, mine took almost five months to get. No errors or problems, just took that long.

If you have a COE with your 03 FFL, you can buy at your local gun store non-prohibited C&R long guns over 50 years old on a cash and carry basis. No DROS is required, but the gun store owner is required to transmit a record of the sale to the DOJ.

The COE usually only take about 30 to 40 days but I have heard of much longer times too.

Not quite.

With a C&R 03 FFL and a COE you can buy ANY C&R Firearm regardless of age from a CA 01/07 FFL and take it home the same day.

You still MUST do a DROS and pay the DROS fee but there is no 10 day wait.

Thanks Joe, actually i remember those sets of postings. My question was about the post above that said the COE was required if one expects to continue using the C&R. If you mean that in terms of the link post from 2011, then ok thats understood. I thought it meant something else completely.

I can go to the COE site but would I find any post-AB809 info relating to the continued use of a C&R?

Im out of the country now. I was just at home and could have done the COE. Dang hmmmm

How does the new law affect out of state C&R purchases? Say I have a FFL03 and a COE, will I be able to order a C&R rifle from an out of state seller and have it shipped directly to me?

yes that ~$100 for the first year is bad, but the re-occurring cost is only $22/year for the COE.

About COE fees, their site has listings of agents and the fees vary. In my area the cheapest is a sheriff's station. It pays to shop around for the lowest combination of charges. I still need my COE, i think I could do it for $60--last time i looked.

I received my 03FFL today. Took three weeks from mailing to receiving. All I received was the license in a thin envelope - nothing else.

Being licensed 03FFL is less intrusive than obtaining a California driver's license. My life has in no way become an "open book" to any agency as a result. There are book-keeping requirements. The ATF has a right to ask for an inspection of one's bound book. This is rare, but can be done at your home OR at their office. I have yet to hear of them inspecting the actual collection.

That said, anyone who frets over the laws pertaining to being licensed should probably forego obtaining one. Anyone who thinks the information packet is "crap" is probably not responsible enough to have one (like the guy from another thread who couldn't even be bothered to look at any of it and posted asking for the C&R list).

The fewer licenses, the more C&R goodies for those of us who are licensed...

I've had my FFL03 for a year now and put a lot of miles on it. The grossly overpriced COE is also inbound in preparation for 2014.

Thats good to hear. The FFL I use in my area gets ATF visits at all times of day. I mean to say they just show up anytime they like, unannounced, and go through records and inventory, sometimes spending hours and asking tons of questions. He said the visits are frequent and he nowadays puts them out in the driveway with a folding table. He would definitely say his life is an open book.

The Shootist shop in Temecula said the same thing, ATF shows up anytime they like and expects all the staff to help in record exams which disturbs their daily work.

When I became a real estate broker in 1978, I also had a mortgage licence rider and as long as I kept that rider I had visits from state officials on pretty much a constant basis. They would just show up and park themselves from morning until night and i would have to sit there the whole time helping them pour over records. Yep, my business life was an open book. Having never found "irregularities" didnt stop the visits. When I left that part of the business the visits stopped forever.

Maybe you have been lucky or others unlucky, who knows. But Ive learned that an over-abundance of records is key. Document everything. My cents.
