Default Interstate intrafamilial transfer of pistol complete lower

California resident x's parent y is a resident of Free State. Parent y has a complete pistol lower (with no upper) parent y wants to gift to child California resident x as an interstate intrafamilial transfer. Can it be done, or does it need to be a complete pistol with an upper?

It can be done, but there has been some question on whether it can be built up to a complete pistol if it was ever semi-auto to begin with. Assuming it never started as a semi auto complete AR pistol then be sure to build it as single shot first.

You're almost better off getting the CA compliant complete AR pistol in semi auto config to start since it's roster exempt anyway then the above "iffy" stuff goes away.

Getting a complete pistol in semi-auto would require free state parent to install the fixed-mag device before transferring it, correct? Don't see how else.

How does one know if a complete pistol lower purchased by the free state parent off the internet (say PSA) was ever built as a semi-auto? For example: http://palmettostatearmory.com/psa-c...ver-black.html

Well when you register the frame, it asks if it is semi, single, ect.
Its EXEMPT so its not a SSE you would register it as it is suppsoed to be built, SEMI.

Yes - has to be CA legal (bolded part) before arriving in CA.

In regards to if it was ever built as semi-auto...you don't know if you purchase from PSA. If they test fired it -- it was semi-auto.

If you would indulge a few more questions staying with the complete pistol lower scenario:

1. How would you DROS it? as a semi-automatic handgun?
2. What is the concern with it having been a semi-automatic handgun at one point? Why do some say it can't it be built into a complete handgun again? (As long as it was never a rifle.)

1. yes as a semi-auto exempt handgun (assuming CA compliant) like I would a gen4 glock
2. If you have a lower that started as a semi-auto CA says you cannot build that into a SSE pistol. Only virgin lowers can be built into an SSE pistol. You can't build a semi-automatic pistol since it would be constructing an unsafe handgun. Building as SSE initially is what gets around that (that's the theory at least)..

Unrelated but sparked by this--if a Californian PPTs a complete fixed-mag pistol and then replaces the upper--e.g. wants to convert it from 5.56 to 300 BO or 9mm to 5.56--is that also manufacturing an unsafe handgun?

If the action remains the same, then no.
If the action is changed, then yes.


Examples...

If the handgun is a CA legal semi-auto pistol in 5.56x45mm and only the caliber was changed to .300Blackout, then it would still be a CA legal semi-auto pistol.

If the handgun is a dimensionally compliant bolt-action single-shot pistol in 5.56x45mm and only the caliber was changed to .300Blackout, then it would still be a legal exempt pistol.

If the handgun is a dimensionally compliant bolt-action single-shot pistol in 5.56x45mm and it was changed to a semi-auto .300Blackout, then it would be an illegal unsafe handgun.

If the handgun is a CA legal semi-auto pistol in 5.56x45mm and it was changed to a bolt-action single-shot in .300Blackout, then it would be an illegal unsafe handgun.
