Lol, I just heard someone on the internet say the Agricultural stop at the CA/NV border is going to search for Ammo after July 1.

Paranoia is setting in I think.

Paranoia set in a long time ago. I have yet to go through an AG checkpoint that is right at the border. I think the one closest to the border is in Dorris, and even then it's a few miles in, and the turn off for Tule Lake is between the border and the checkpoint. I haven't been able to find an LE subsection that applies to Ag inspector's at the checkpoint's, haven't looked real hard either.

For an infraction the officer would have to witness the transaction, and the person crossing the border. Not going to happen with budget's the way they are, too much expense for no real gain.

Just for completeness I’d like to hear a legal opinion on what powers these stations actually have.

Can they demand to search me and/or my vehicle for bananas? Ammunition? Drugs?

What if they demand (not ask) to search? Can I say no and drive away?

I’ve always been curious.

Simply put, have the Highway Patrol ever come to your house to give you a ticket regarding your barking dog?

The Agi stop is more concerned with a truckload of fruit coming in spreading the fruitflies again. I would also assume that Pot transport/import would be riskier than anything metal.

My non-legal reasoning would say that without probable cause there is no legal search warrant. If everyone says they have no guns or ammo when coming back from "vacation" then the worst they can do is back up cars and trucks since anything else would be illegal search and seizure. A call to the media would be embarrassing or cell phone video on the internet showing gestapo behavior by fruity inspectors. this would turn into a media nightmare if done right.

With the exception of assault weapon's it is perfectly legal for a non Ca resident to bring both into the state. So just one more waste of our tax dollar's.

I agree, and you're feeding it from a source you won't name.

I called a relative of a relative who's been with the CHP for a long time. I asked him about ammo searches at border crossings.

He started laughing...noted that staffing the 16 ag inspection stations 24/7 would not be possible with current staffing. He told me I must be joking.

My experiences with Ag. inspection stations is either:

1. Waved through.

2. "Any fruits vegetables or firewood?"
"Nope."
"Have a nice day."

I would find it hard to believe they will stop the Fwy and commerce while they searched every car, truck, van or motorcycle for ammo.

Plus which if you are going to go into the ammo smuggling business. Look on google earth. There is a way around the checkpoints.

I have seen them checking deer and other game coming it. But that probably falls under Food and Ag and it may have been DFW.

We’ve been stopped twice at the check station on 395 when coming back from hunting out of state. They made us fill out and submit the “declaration of entry” forms for bringing game into the state. This only happened because of the visible elk antlers in our trailer. There were no cavity searches looking for ammo or other contraband.

I'm a truck driver. Every week I went through the check stations on I-40 & I-80 (not anymore, I moved to AZ last year).
They waved me through without stopping 99% of the time.

Active searching, no, but it would cost them nothing to add "or ammo" to the end of that question. Just asking, and people finding out they are asking, is its own kind of deterrent, if that's their goal. They don't have to actually catch anyone, and they likely don't actually care if they ever do. Though surely people will self-incriminate. And our glorious legislature will smile and feel good about themselves for saving so many children.

In the last year I have been thru the North State CA Ag Inspection Stations on Hwy 101, Hwy 199, I-5 at Yreka, and Hwy 395 north of Reno and North of Alturas and never had my vehicle inspected for "guns or ammo" with visible rifle hard cases and piles of gear in the back of my truck...

Also surprised to see what happens after 8-9 shots of espresso.

It was a might-do, could-do, maybe-do, blah-blah. He also noted the possibility of California LE hanging out and around ammo dealers across the border.

Pure supposition, but no mention of budget issues in LE making it improbable, at the least.

Not unexpected from someone who sells ammo...follow the money.

I saw this video and there is so much FUD.

First, non-residents can import all the ammo they want when they visit the state. The restriction on importing only applies to CA residents. This has been noted in the many threads on here about the law.

Second, the 50 round import limit for residents that went out of state was in the bill passed by the state legislature but was overridden by Prop 63, so CA residents cannot legally import any amount unless they are in one of the exempted groups.

The first time one is convicted of importing is an infraction. In order to be charged with that, a LEO must witness the act of purchasing out of state and then follow the CA resident back into CA with the ammo. They have to keep the person under observation the entire time. They cannot have someone witness the purchase then call ahead to the agricultural inspection station to search the car for ammo. Even if ammo is found the officer is required to prove that it was illegally imported.

The law allows one to take legally owned ammo out of state and return with the ammo that was not used. The law allows one to legally import ammo that was acquired from a direct blood relative (parent, grandparent, child) or from a domestic partner or spouse. One who has a FFL03 and COE can also import into the state. So the officer will have the burden to prove that your spouse did not give you the ammo while you were out of state or that your mother did not give you the ammo while you were out of state.

Is an officer really going to go through that process to enforce a ticket with a $50 fine. There are not enough CHP officers to ticket the majority of the speeding drivers and those fines are much higher than the ones for importing ammo.

It has been a few decades since I have driven through an agriculture check station. I stopped driving through them after two bad experiences with the one on I-5 south of the Oregon border where I was made to completely unload all the boxes in my Toyota pickup while moving between college and home at the end of the spring quarter in the middle of a rainstorm. They were searching for plants and fruits. I was left to reload the truck on my own with my cloths, books, and research equipment getting drenched in the rain. My research sites were in CA. This was in the 90s. After the second time I drove around it using the backroads the locals used.

I drive to Carson City every two months. I use highway 88 and their is not an Agriculture Inspection station on that highway. It is the most direct route from where I live to Carson City. There is a Sportsman Warehouse in Carson City. I run into people from CA buying ammo every time I am there. They openly admit their intention of bringing back to California. I do the same. I do have my FFL03 and COE so it is legal for me. I usually go with my son so we play the game of I give him some ammo and he gives me some so the ammo meant for him is legally his and the ammo meant for me is legally mine.

Prop 63 is unenforceable. It is a feel good law that does nothing. You can even receive ammo from a directly related who lives out of state by having sent directly to your home without going through an ammo vendor.

AG stations do NOT ask about nor inspect for ammo...they're looking for plant and plant products.

Yes there certainly IS a Station in Meyers BUT "Locals and
Tahoe Returnees" bypass the station on the right side and continue on their way, mostly the "honor System"
