Default How to surrender a banned assault weapon?

A friend of mine is in a bit of legal trouble and the judge ordered him to get rid of his guns. One of them is a banned assault weapon. Yes they ran his record of ownership and it came up. Cant sell it out of state because time is of the essence. Any suggestions how to legally surrender it and not face a felony possession of a banned assault weapon?

He needs to consult and work through his attorney.


If it is banned by name under Roberti-Roos or Kasler, there is nothing that we can recommend or he can do on his own that will not risk a felony charge.
If it is banned by feature, then disassembly and transfer of the lower separately *should* suffice (again, he needs to consult his attorney)
If it is a registered BBAW, then his only option is to turn it over to the police for destruction OR transfer to an FFL with an AW permit.


He needs to consult and work through his attorney and not a bunch of strangers on the internet.

"may arrange in advance" = have your lawyer work a deal for surrender in lieu of felony charges.


Penal Code 31100
Any individual may arrange in advance to relinquish an assault weapon or a .50 BMG rifle to a police or sheriff’s department. The assault weapon or .50 BMG rifle shall be transported in accordance with Sections 16850 and 25610.
