Cool Cited for PC 32310

Recently I was cited for PC 32310. I believe that PC 32310 starts effective July 1, 2017. It is still June 2017.

Can I still be charged in court?
Can I get my std. cap magazines before the effective date so that I can move them out of state?

Any pointers would be appreciated.

It is a misdemeanor and yes the penalty is $100 per mag. Not sure if they can charge me for manufacturing under that PC.

Don't answer OP, but how the heck did LEO confiscate his stuff? Did they have a warrant? Does he travel with his gun cabinet and parts? If it is only a cite, why did they confiscate everything?

The magazines are gone.

CA PC 32390.
Except as provided in Article 2 (commencing with Section 32400) of this chapter and in Chapter 1 (commencing with Section 17700) of Division 2 of Title 2, any large-capacity magazine is a nuisance and is subject to Section 18010.


CA PC section 18010
(a) The Attorney General, district attorney, or city attorney may bring an action to enjoin the manufacture of, importation of, keeping for sale of, offering or exposing for sale, giving, lending, or possession of, any item that constitutes a nuisance under any of the following provisions:
(20) Section 32390, relating to a large-capacity magazine.

(b) These weapons shall be subject to confiscation and summary destruction whenever found within the state,

(c) These weapons shall be destroyed in the same manner described in Section 18005, except that upon the certification of a judge or of the district attorney that the ends of justice will be served thereby, the weapon shall be preserved until the necessity for its use ceases.


Do not share details, get an attorney.

A vote is clearly much more dangerous than a gun.

Why advocate restrictions on one right (voting) without comparable restrictions on another (self defense) (or, why not say 'Be a U.S. citizen' as the requirement for CCW)?

The cite is so they can approach a judge and get a warrant to search.

The literally opens doors for the police.

This is really bizarre. Very strange thing to get a citation for a statute that isn't even effective yet, even stranger that all your belongings that weren't even involved with the citation got confiscated.

You don't have to divulge any details, but I'm sure we all would like to at least hear an update once there's an outcome.
