Default Uncle Eds/AW craziness

So, I went to uncle eds outfitters in Atascadero to pick up some firearms I had ordered from Atlantic. They wouldnt accept rebuild kits, so I had them sent without magazines.

They told me they could not release the maglocked rifles to me without 10 round magazines in them, then he showed me this,
"2) A semiautomatic, centerfire rifle that has a
fixed magazine
with the
capacity to accept
more than 10 rounds"
and said since it has no magazine, it is an assault weapon because I could put a 30 round magazine into it. I was awfully confused, I had purchased several firearms previously with no magazines in them(from another FFL)

So, we talked for a little while, he said every time you drop a mag and reload with your bullet button, you are committing a felony.

FUD, or, did I just have a serious misunderstanding of the law?

Yeah, I argued with them for 5-10 minutes, then decided I would just go along with it, bring it some 10 rounders on my pickup day and be done with them for good.
The only reason I chose them is their transfer fees/how many firearms per transfer. Any other local place would have cost me 100$ per firearm...

Browse the FFL section or run a search. There has to be atleast one knowledgable, correct, and happy kitchen table FFL in your area.

I was at the Paso gun show about 2 years ago and heard the same B.S. from them. I don't think it will change.

A- There is no law saying a firearm without a magazine is a fixed magazine firearm.

B- The law states the FIREARM can't accept a detachable magazine, and since any magazine that is inserted can't be detached, its not a detachable magazine firearm.

C- So until an 11+ round magazine IS IN FACT inserted its not an AW.

D- With his logic every gun he sells is illegal because it could be altered into an illegal one.

First. It's not a centerfire until you put an upper on it. Second, it's not a fixed magazine until you attach it. Gun shops are interesting for sure, they are all full of crap but interesting none the less.

Please explain to all the idiots who read things into the law learn proper English.

A semiautomatic, centerfire rifle, with a FIXED MAGAZINE that has the capacity to accept more then 10 rounds means...

the magazine is --- FIXED.
The magazine --- has the capacity.

The law refers to the magazines capacity, not the rifles capacity to accept other magazines.

Every rifle has the ability to accept another magazine, therefore under his FUD all SA-CF rifles are AWs.

A rifle with no magazine is neither fixed nor detachable if it has a magazine release which requires a tool to detach AFTER the magazine is inserted.

I'm going with; w/o a mag it is a single shot.

It has no fixed magazine. 10 rounds, 30... fifty. So all you can do is load one at a time...

Buy a 10 round mag from him and finish the sale. Once you're all done and you have your items in hand, hand him the calguns flowchart and a copy of the exact law. Then tell the owner you will never buy from him again and that you will inform the calguns community about what transpired warning other members not to shop there.

This is the only way they will understand. When you hit their pocketbook.

OP, Look up the FFL's listed on GunBroker. There are some very good FFL's in SLO and SB counties who know the law and will work with you and they won't rape you with transfer fees.

Dealt with with a dealer like that when I sold a AR to a guy and had it shipped to his local gun shop. Made the mistake of shipping the mag loose in the box....... Had a very interesting phone conversation to say the least. The owner of the shop scolded me like I was a child. When I told him that I was 58 (at the time) he change his tone.

I'm not even gonna buy the mags from them. I already have some 10s i can bring in.
I really dont think any amount of convincing i could do would satisfy them, as i was told, "Ive been doing this for 10 years." I actually requested he call the ca doj and ask. No one answered though.
He actually had some little law booklet he showed me too, so he knows the law, his interpretation of

I keep switching between he and them, there were two 30 something males, just to be clear.

Maybe he's one of the "old timer" types that doesn't really like the "assault rifles", there are a lot of those folks around. If it doesn't have a wood stock some of these folks get nervous.

Too bad you got stuck with that type of FFL. You'd think they all have a common understanding, but they don't.

I've heard pretty good things, but when I called and asked them about transferring these firearms, he said "we dont really deal with those types of firearms."
I am not exactly sure what "those types of firearms" are, but, eh, I am not going to get angry over the phone about it.
Also, before they told me ^, they said it was 100$ per firearm.

Uncle Eds is usually pretty good. I have never done a transfer through them but they are great folks who care about 2a. I second the 4 seasons thing, those guys are awesome! and always willing to help. Granted I wanted to buy a Mosin online and it was $50 for them to ship into there plus the DROS fee. 4 Seasons also has some of the best pricing on ammo in the area.
