Default QUESTION FOR LE (HOV lane enforcement)

QUESTION FOR LE. I ALWAYS DRIVE ON 605 FREEWAY GOING TO WORK TOWARD 105 AND I ALWAYS SEE PEOPLE HOPPING IN AND OUT OF CARPOOL LANE BUT I NEVER SEEN LE DOING ANYTHING ABOUT IT. DID THE CARPOOL LANE LOST MEANINGS?

If you want carpool violations, CHP hammers folks on the 110 NB at the 405/91 and 182nd street on ramps.

I was driving 2-3 times per week over a two month period from Gardena out to Pomona for an event with my son, hence we would be two in the car and use the 91/57 carpool lanes. It simply amazed me how many times cars occupied by one person would simply cross the double (or double double yellows) in front of us, and then suddenly do the same back into regular traffic.

CHP would normally handle carpool lane violations. However, they are short staffed and usually handling a traffic collision, which means there won't be another CHP officer for miles....

CA motorists are increasingly not giving a darn and just taking their chances...

Eventually they'll get a ticket, it's just a matter of time

I recently read that CHP can only enforce HOV while on overtime.

I doubt that quote is accurate. I don't think I have ever seen a law that can only be enforced by anyone authorized to enforce it only on overtime status, that would be just plain stupid.

What it is probably trying to say is that the MTC (which is a Bay Area commission, not statewide) can only have CHP dedicated to enforce it solely on an overtime basis.

Here's one I always wondered about. Let's say you had one of those panel vans that has no windows in the back and you're driving by yourself in the carpool lane. A police officer sees you drive by with no one in the passenger seat. The officer stops you and cites you for the violation. Could you fight the ticket based on the officer's PC for the stop? Since they can't see in the back they can't see if you're alone or not.

The PC is you appear to be a single driver in a panel van. Panel vans don't usually have seats in the back and if you did and someone was belted into them, you would not have received a ticket in the first place.

Semi OT .. When my kids were infants, I used to drive in the HOV lane with them in the back. Always wondered when or if I was going to get pulled over. Figure I'd pull over, smile, and point to my kiddo in the back. Never got a chance to do this as I was never pulled over..

They don't have to KNOW you committed a violation, only have reasonable suspicion. PC, probable cause, is really not the standard for them to stop you. They just have to reasonably suspect that you may be in violation, then they can stop you to investigate. If they walk up and no one else is in the van, then BINGO expensive ticket. If they walk up and you have a passenger then no ticket for the non-existent carpool violation.

I can use the HOV lane with my 1 year old in her car seat but I don't because I assume any CHP officer that sees me will pull me over and even though Im not breaking the law I don't want to hassle with a traffic stop.

I've pulled over many cars in the HOV lane with a baby in the backseat. I just walk up and apologize and tell them to have a nice day.

I know a young techy female who drives in the BIG lane always.
If she gets a ticket, she considers it an HOV fee.
6 years. No ticket.

Of course the law can be enforced at anytime, it's just resource allocation. A local PD I work in conjunction with a lot does the exact same thing but with cell phone violations.

I was cruising the car pool lane one day and my child was in the passenger seat, leaned back asleep. Cop saw me, cut through traffic, got close enough that she could actually see him sitting there, and went on about her business.

And there seems to be a push for the CHP to provide security/safety for construction crews, reducing roaming units.

In a few years this problem will go away. Most of the carpool lanes will be turned into toll lanes. They just announced this morning the 10 fwy from Claremont to Redlands will become toll lanes. Just another untapped revenue source as far as the government is concerned.

The question I've been asking myself is was this the plan all along? Most Californians would have squawked if they had built the carpool lanes as toll roads from the get go. But now just converting them to toll roads seems not as big of a deal. Win Win for the government.
