Default C&R ... need ammo vendor lic. In 2019?

Not sure if this is the correct form for this. I just received my c&R ffl back and COE. Looks like a lot of online ammo vendors have proper understanding of the new laws and are willing to allow CNR ffls to set up accounts. My question is in 2019, as long as the ammo if for me
Do I need a vendor lic?

No, you only need the vendor license if you plan to sell more than 500 rounds per month

Sorry, but this is just the response I got from Sportsmansguide to my continuing purchases of ammunitions.

Dear Sir,
Unfortunately we are unable to ship ammo to California, including to FFL dealers at this time.

In addition we do not ship firearms to a type 3 license.

I have had several vendors honor my o3ffl and coe. They just needed to have me fax the forms, and they will honor it. We need to make a list of vendors who will ship ammo to 03&COE holders in Calif.

No loss there deal with someone else besides Sportsmangouge! They are idiots!
They once wouldn't send a replacement scope for a returned defective one "because it MIGHT be used on an assault rifle" The same scope was available all over CA at Wally World and Big 5!

Like Cheaper Than Dirt, SG is always one of the first to refuse to stand up for California gun owners, refusing to sell perfectly legal items.

Try buying a pistol grip for your legal rimfire AR22, or a bayonet for your Garand.

No big loss to us... Californians shouldn't be spending ANY money with them.

Will FFL03s with COEs need background checks for internet ammo purchases in 2019? Or will that only a be a requirement for in-state purchases?

I believe you are EXEMPT if you have a C&R FFL and COE.

C&R FFL + COE = exempt from needing to transfer through licensed ammo vendor. [PC 30312(c)(6)]
^This applies to private party sales* [PC 30312(a)(1)] and sales made online/mail order [PC 30312(a)(2)].

C&R FFL + COE = exempt from needing to import through licensed ammo vendor. [PC 30314(b)(5)]

C&R FFL + COE = exempt from CA DROS & background check on ammo transfers from a licensed ammo vendor. [PC 30352(c)(1) & 30370(a)(2)]
^Not sure how that will be implemented, since regulations governing this has not be released yet.



*Private party sales within CA...
C&R FFL + COE is exempt from selling and buying without having to utilize a licensed ammo vendor.
But, the other person buying/selling must also be exempt from needing to utilize a licensed ammo vendor.

Which means a C&R FFL + COE can only buy/sell to the following without having to utilize a licensed ammo vendor:
1. LE agency employees with written authorization from their CLEO. [PC 30312(c)(1)]
2. LEOs. [PC 30312(c)(2)]
3. Types 07, 08, 10, 11 FFLs. [PC 30312(c)(3)]
4. Non-resident with a C&R FFL. [PC 30312(c)(5)]
5. CA resident with a C&R FFL and COE. [PC 30312(c)(6)]
6. "consultant-evaluator". [PC 30312(c)(8)]
7. LE academy recruit or LE academy instructor/staff member. [PC 30312(c)(11)]

What the heck is number 6 "consultant-evaluator? What are the qualifications?

Just wondering, never heard that term before.

Doh, I just started the process of getting my FFL03 thinking that was all I needed for online ammo purchases. I also need a COE?

Yes. You'll need a COE regardless as the FFL03 is pretty much worthless in CA for anything you would want to do without it.

As part of their job in the firearm industry, a person that has a valid COE and has a business contract with a FFL(s) to evaluate firearms. [PC 16410]



Penal Code 16410
As used in this part, “consultant-evaluator” means a consultant or evaluator who, in the course of that person’s profession is loaned firearms from a person licensed pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, for research or evaluation, and has a current certificate of eligibility issued pursuant to Section 26710.
