Default Out of state LE carrying under LEOSA-ammo "importation"?

Can out of state, LEOSA qualified, LE bring any ammo with them from out of state after the ammo restrictions begin January 1, 2018?

If they can't, is it going to be possible to buy ammo locally?

Ammo importation restrictions only apply to CA residents.

As non-residents of CA, they can legally bring ammo to CA.

They can not bring prohibited ammo (explosive, incendiary, tracer, flechette, handgun AP) unless it's for official duty use.

Default LEOSA: Out of State with New Ammo Law

Hey guys,

I was planning on visiting some family back here in California and I was planning on carrying my off duty gun. I am confused regarding new ammunition background check law.

Is it unlawful of me to bring my duty ammunition If I'm flying from out of state?

No, even after the background check crap goes into effect in 2019 (I think), it only effects sales.

And the importation only applies to California residents going out of state and bringing ammo back.

Was actually reading through the 2018 legal update crap and it states:

Pen. Code § 30312

(c) Subdivisions (a) and (b) shall not apply to the sale, delivery, or transfer of
ammunition to any of the following:
(1) An authorized law enforcement representative of a city, county, city
and county, or state or federal government, if the sale, delivery, or transfer
is for exclusive use by that government agency and, prior to the sale,
delivery, or transfer of the ammunition, written authorization from the
head of the agency employing the purchaser or transferee is obtained,
identifying the employee as an individual authorized to conduct the
transaction, and authorizing the transaction for the exclusive use of the
agency employing the individual.

(2) A sworn peace officer, as defined P.C. §§ 830 et seq. (Part 2, Title 3,
Chapter 4.5), or sworn federal law enforcement officer, who is authorized
to carry a firearm in the course and scope of the officer’s duties.

So you're covered.

Yes, LEOSA preempts any ammo not prohibited by federal law. It doesn’t matter what CA says.

Please understand I am not trying to be argumentative, but LEOSA covers ammunition. While California does restrict some types of ammunition, unless the ammunition in question is specifically prohibited by Federal law it is legal to import and carny in California by those covered by LEOSA.

"(e) As used in this section, the term `firearm'--

`(1) except as provided in this subsection, has the same meaning as in section 921 of this title;

`(2) includes ammunition not expressly prohibited by Federal law or subject to the provisions of the National Firearms Act ; and...."
